The measure is considered the country's newest attempt to promote homosexuality, disguised as an act to prevent discrimination, the Catholic News Agency reports.

If such a legitimate reason exists, it should be easy enough to prove.

She sued him for racial discrimination and WON. She got so much cash that she pretty much cleaned the guy out. I'm not sure, but he might have gone out of business as a result.
Never mind that there were only a handful of whites in that place -- the vast majority of employees were various ethnicities other than white, and they backed up their boss in court, but the judge bought the lie. Laws were created to protect people from companies discriminating against them because of these attributes. One has to wonder the validity of a law to prevent discrimination against something that shouldn't even be observable in an interview. What is the definition of "openly gay"? There is no box on application forms that ask you for sexual orientation so how does an employer even determine if someone is gay or not unless the candidate makes it a point to declare their sexual orientation. In this case it is pretty clear that homosexuals are making their sexual orientation more of a conflict than heterosexuals are. How would you ever prove that someone wasn't hired because they were gay especially when sexual orientation isn't part of an interview process.
Next there will be affirmative action for homosexuals and companies will be forced to hire "openly gay" people regardless of the job skills they possess. - Cate320, on 07/19/2008, -2/+1Well, some people seem to think that they can tell the difference between a homosexual and heterosexual on a purely superficial level. I think they are probably more often wrong than right, but laws like that have to exist to protect people from that kind of discrimination. "Openly Gay" probably, to bigots means effeminate men or "butch" women. The employer can't tell for sure unless the candidate makes it clear, but that wouldn't stop them from making a judgment anyway. Rjwusa in another post in this thread said he finds a reason to prevent hiring someone if his "gaydar" goes off. The law is to protect potential employees from people like him. Even if the topic is never approached in the hiring process, it still may come out while the person is employed. This protects them from being fired because of it as well.
Affirmative action doesn't necessarily have to follow (and I hope it doesn't!). I would certainly speak out against affirmative action for homosexuals, since I don't agree with it's existence for minorities and women either.

No it isn't, not in America. Whites had that right not too long ago and they colluded against blacks to deny them jobs and a livelihood. Blacks were forced to live as second class citizens because whites had the 'right' to exclude them from commerce.
Read about Adam Smith's 'invisible hand' and John Maynard Keynes opinion of it. Not every decision made by consumers, as a whole, is necessarily beneficial to society. Read about the 'paradox of thrift' and you'll find that the mere fear of recession can drive a growing economy into recession.
Most economists agree that the state should correct for the failures of consumers. This is why there are anti-discrimination laws, because it's harmful to the economy and society. Don't believe me? We have two kids and live in the country here in Australia. Our sexuality isn't 'traditional', whatever that might mean. But we run a successful local business, and deal with people from all walks of life. We are accepted in the local community for who we are, we hire based on skill and work ethic.
My electrician is part of a religious community called the brethren, he is one of the nicest people I know, and like most other people, he is nonjudgmental. There's no way to know if a person is anti-gay rights/anti-Christian unless they vocalize it in some manner. If, in an interview, I said, "your organization sucks and I hope it fails", then I'd expect not to get the job. Not only that, I'd have no leg to stand on if I filed a lawsuit.

People can refuse to hire individual Hells Angels for various reasons, just not because of their skin color, sexual preference, religious choice or gender. Is the 'bad feeling' that the guy is gay? If so then it's discrimination and illegal. If you interview a transvestite for a position at a men's clothing store you should mention that the attire is suit & tie. If the transvestite refuses then you can exclude them from being hired. I didn't read that, because I didn't see anywhere in there what Brazil's laws for anti-discrimination against race, ethnicity, religion, gender, etc. are. But it needs to boil down to equal rights, not special rights. If it's special rights, then we need to address that it should be on par with race and others, or that others need to be on par with sexual orientation.
I don't think it's dead wrong to tell someone they can't choose to hire people based on their skin color, or their gender, or their religion, or their sexual orientation.
You won't ever face jailtime because you don't have black, gay, female, or jewish friends, so don't fear it going that far.
