No one, who can't make a clear distinction between a Taser and a real gun, should be allowed to carry one, let alone use one. While I could sympathize with the cop, trying to tase a suspect who was struggling (and not handcuffed, as this article suggests) and suddenly finds himself firing a real gun, he has the responsibility to man up to his mistake and accept plead guilty to murder charges which NEED to be filed.
At the same time I am sickened by the rat lawyer who aligned himself with the family. Instead of leading the charge for formal criminal charges to be brought he's been saying that he's going to sue BART for $25 million. There are at least two different amateur videos of the event. One taken from inside the train with the cop facing the camera and the other from the outside train with the cop's back to the camera. In the latter's case the camerawoman reported an officer demanding the camera be handed over. A friend of mine is Sociologist and a Psychiatrist. About 15 years ago, the state of Florida paid him to test inmates and correctional officers at a state prison to develop some personality types. He told me that the personality scores for the inmates and correctional officers were indistinguishible from each other. Thugs by any other name are thugs.

I would suggest to go and ask yourself why there is so much police violence in the US.
In the recent Athens riots, as the police ran out of tear gas they picked up stones and threw them at the rioters in turn. Classy. That was a street-battle not a war. Everybody (in Athens) got that.
The general level of violence all over the country is just mad and the only solution that the nation has is to lock up more people and "crack down on the evildoers really hard"?
Does neither work at home nor abroad.

I was sitting near the middle of the cart and all I could hear was people outside screaming and just sounded like two group of people fighting. Then, there was a cop who just passed by and then I later hear the gunshot. I remember when everyone just wanted to go home and the driver of the BART train finally told everyone to get back into the train so that we can leave. He was actually shot in the lower back and the bullet went through his lower back and ricocheted off the ground and into his lungs.

Just ask yourself what would happen if a police officer was handcuffed and shot in the back? Then do the same thing to the police officers involved in this case.
And any police officer there that witnessed this and did not immediately arrest the officer that assassinated this individual in cold blood need to be charged as accessories to the murder.
Perhaps everytime the cops murder someone in their custody then none of them in that department should be allowed to carry a weapon for a month after one of these incidents. My father is a cop, was for some 25+ years and now works with a federal agency. He'll tell you straight up, there are some bad cops out there and those few make the rest look bad.
But then, being black, I've been stopped and questioned for walking in the wrong neighborhood at the wrong time, been told "you fit the description", been stopped for DWB, have had cops escalate a simple traffic ticket situation for no apparent reason. And it makes me stop and think, where are the good ones and why do I always end up having to deal with the bad ones?
