I've never understand why people that are squeamish about quickly killing somebody would argue for something even more tortuous! It seems like either a red herring argument, or "church logic" at work.
It costs a lot of resources and time to rehabilitate someone, shouldn't that be allocated towards educating and rehabilitating those that didn't already knowingly impose and take advantage of someone's weakness to exact _irreparable_ costs in pain and suffering, all the while missing every cue for humanity to enter as their victim begs for mercy?
People feel good to empathize, but in cases like this I'd draw the line. Someone out of their kindness helping someone like this (rehabilitation, etc) ends up wasting _everyone's_ time and resources because their help could have been spent on just about anything else more beneficially. - btschul, on 06/07/2008, -2/+6The obvious punishment is do whatever he did to her to him. The point of the justice system is simply to provide a solution to a problem. The nature of the problems that justice systems deal with are things that are harmful to society.
Ending the life of the criminal in cases such as these heinous crimes is really the most effective way to solve the problem. As far as we know, death is an irreversible process, so it's the only guarantee of knowing that society was protected from this person. Life in prison sounds like it might do the trick, but don't forget that people can get out of prison (by whatever means), and it harms society to support them for life (eg provide them with food, clothing, etc). - btschul, on 06/07/2008, -0/+1It's not revenge so much as the deterrent value of the knowledge that whatever you do to the person will eventually happen to you. but I see your point. also, a system like this would be extremely impractical. How are we better by letting them live? How are we better by dedicating resources to these people who don't care about their life or anothers? How are we better by locking them away in a prison where they will be treated humanely for the rest of thier lives and never truly pay for the trauma they inflicted on the families they affected.
Say what you want, there is no argument on earth that would make me think we should outlaw the death penalty. Even in higher animal societies traitors to the group are disconnected from the rest and typically chased off and killed if they return. Some wolf packs actually kill members who head out on thier own simply because it is detrimental to the group.
As far as I am concerned nature and common sense dictate that people willing to commit these atrocities for no reason are trash and should be dealth with as trash. Their rights should be stripped away and they should be massacred in the public forum to openly discourage the behavior like they do in some 3rd world countries.
There is no "1st world" solution to handling those who have nothing to lose. The man was a violent homeless criminal with likely little to no fear of being caught and probable mental damage". No amount of rehabilitation will ever make this individual fit for society.
The real question is why do we waste electricity and gas when we can simply slit their throats or put a bullet through their temple. If they don't die right away...let them bleed out. The cost of mandatory appeals alone far exceeds incarceration costs. Besides, death penalty cases are segregated in solitary cells, so there is no chance for prison justice.

Children from what I understand, child molesters etc. do not fare well in prison. I do not think there is any stigma about Rape/torture of women. He let me know that the tales of prison rape and beatings are greatly greatly exaggerated and that only a few prisons have a real reputation for such things.
He told me stories about the daily goings on all the time and from what I remember most of the murderers pretty much spent 90% of their time in their cells and the rest of the time they were under constant supervision if they were in a room with any other inmates for any reason.
You fail to realize that you be beaten you actually need to see another prisoner to beat you. Outside of lunch prisoner mingling is at a minimum at most higher security prisons that would house this type of criminal. Some even have showers right in the cell or showers on wheels that are brought to each cell...

Our justice system is not based on the 'eye for an eye' philosophy. Hoping that someone will be tortured, raped, or killed in prison is wrong, no matter how terrible that person's crimes are. Let's not stoop down to this criminal's level. Life imprisonment in a small cell with little to occupy my time and little control over my life might drive me insane. It's not a comfortable existence. It still may not feel sufficient to exact our revenge on this person as a society, but punishment is not the same thing as revenge, and nor should it be. Ever since being raped at 9 I've always felt that the legal understanding of life should be changed to the complete destruction on the life you had either through murder or worse, high emphasis on the malice involved. We often see on Digg how individuals in the justice system can abuse their power with false arrests and abuse of power. The people that they usually choose to exert this power is on marginalized populations due to their lack of knowledge of their rights. It's very easy to jump in and say "well obviously that drug user stole from the store", and yes they probably did. They also deserve not to be abused by those in power.
With that said this guy should get his day in court. After that though... I hear water boarding is fine by the US govt. If you look at the data that the NYPD collect on violent crime you will see that such a vast disproportion of this type of crime is caused by blacks and the rest is caused by hispanics. Whites virtually never cause this type of crime.

The problem with your logic is that you're saying that every "sin" is equally bad. I'm a better person than the guy who did this. I can say that. Why? Because I would never EVER in a million years so torture, rape, burn, cut, and bludgeon a woman for no reason other than my own self satisfaction. Sure, I've lied before. I've said nasty things to people, hurt their feelings. Yeah, that was bad of me. But it wasn't even CLOSE to as bad as this. I'm almost insulted that you would say my sins are comparable to a crime of this magnitude.
Oh, finally, I know you're not Christian, but this is the ultimate Christian hypocrisy. What I'm saying is most people on Digg would NEVER torture, rape, and cut an innocent woman, but based on these comments they would gladly torture, rape, and cut a criminal... it doesn't matter what that person has done, violence is never justified. If we lock the guy up then we do something good for society. I think the moral problem, at this point, is determining what constitutes proper punishment and whether or not punishment should really exist at all.
The purpose of punishment is to deter future behavior for both the perpetrator and for others who might commit similar crimes. In this case, the perpetrator is most likely so insane that I doubt ANY punishment would do anything. Thus, for society's sake, he should be locked up for ever, and/or killed (does this involve violence?). From society's perspective, barring tax dollars, life in prison, death penalty, or banishment to a beautiful island somewhere is the same thing: he is harmless.
From the moralistic perspective, we should give people what they deserve. This is where it gets tricky: he obviously hurt someone tremendously, so what should he deserve? It's understandable that people think the punishment should fit the crime--the anger they feel at such an act of cowardice and brutality can only be quenched by an equal punishment of violence. Any other punishment and he would be "getting off easy." What makes the punishers and the perpetrators different is their motivation for violence: in one case it's to serve punishment; for the other, it's some twisted form of self gratification. - Radan, on 06/06/2008, -2/+1@mardybum:
