HIV-positive man sentenced 35 years for spitting at officer
newsday.com — An HIV-positive man convicted of spitting into the eye and mouth of a Dallas police officer has been sentenced to 35 years in prison.

- SirDomino, on 05/15/2008, -1/+4So is this discrimination? If a normal person spit at a cop they wouldn't have received such a sentence. Plus hasn't it been shown that it is highly unlikely for HIV to be spread through saliva?
- Sleepensheep, on 05/15/2008, -6/+0Is it discrimination?! That's like wondering if it's descrimination against a stronger man when he's convicted for assault. If he actively used his saliva as a weapon, he's guilty. Period. If he sneezed, then he's innocent.
- SirDomino, on 05/15/2008, -1/+3I didn't say he was not guilty. But this does some to be bordering on cruel and/or unusual punishment. 35 years in jail for spitting. He probably would have gotten off easier if he had used a gun.

- SirDomino, on 05/15/2008, -0/+4"Saliva is NOT an infectious fluid due to the enzymes in it that break up the virus. The pH level of the mouth is detrimental to the strain. There is not a sufficient concentration of the virus in saliva to consider it infectious.
The virus MUST be in the blood stream for a person to become infected."
