I made an analogy before on Digg of an "employee only" door in the back of a store and how you are technically trespassing if you go in it. Your not likely to be arrested if you accidentally walk in such a door. But if you damage the place you likely will be. In the case of the Myspace situation the women made a mess and a young girl tripped and broke her neck. In the Presidents case peoples right to parody and protest a political leader likely trumps the trespassing violation. The person walked into the "employee only" door and left a poster that said the store mangers sucks and left.

The protester caused no damage he taped a poster to the wall. The prosecutor chose to selectively charge the women with the lesser crime of trespassing because they could get an easy conviction.

A 13 year old girl trying to find a boyfriend on Myspace is not a public personality and should not be expected to have as tough skin as some typical slime ball politician.
