Were the FCC required to prove in court that the ISP was guilty of something, or did they just send their agents in to confiscate the equipment? Even if this was the ISP of the scum of the internet, I am still not comfortable with the idea that the FCC can just close an ISP down without any safeguards.
People might celebrate the loss of spammers right now - but in a year or two, we might see the FCC shutting down ISPs which refuse to take measures to block p2p file shareing. In the meantime the Federal Government has established a new precedent. Any server they want to shut down will now simply have to be accused of hosting child porn. I'm not saying it should be allowed to operate. It's a tough question. But in reality, this move will stop very little, and has made it ok for the Federal government to shut down ISPs on whatever evidence they wish to present.

The basic botnet uses a control server - often it's a secret channel on a public IRC network. Such things are easy to program and easy to use, but they also create a central point of failure or of vulnerability to takedown. So fancier botnets use some form of p2p control: A command message is cryptographically signed with a private key, and given to any bot on the network, at which point it's propagated around until they all have it.
The commands don't have to be that fancy. Usually it's something like an executable file (A spammer or a DoSer), a time at which to run it, and a time at which to cease running it.
