How are you going to establish that they knew the money wasn't theirs? If money is deposited into my account I don't trace every deposit back and insure it's really mine. If it goes in there I assume it's mine unless the bank tells me otherwise. And assuming I remove the funds before the bank says anything, then I should be free and clear after I withdraw the fund. And why would I take the time to insure that money deposited is mine in the first place. It's in my best interest to accept all funds deposited and assume they are mine.
The bank should own it's mistake in that case. But assuming the bank contacted the couple and said, we accidentally did this, we'll have it corrected in a few days, then by chance they were successful withdrawing it, I'd say the bank can make this claim...
Seems unlikely the bank knew they'd made a mistake until after the money was gone, so I find it weird that the police are doing anything at this point besides saying...don't give people millions of dollars by mistake in the future.
Fleeing the country seems dumb though. It was likely in the thousands because you don't just go into a bank and withdraw millions of dollars in cash and then leave the country.
Even off shore accounts are traceable these days. - Karmakongen, on 05/21/2009, -0/+7I would have likely done the same thing as these people, but it sucks because that is a lot of money that has to be made up for somehow, and if it is a small bank, perhaps a local one, then it could be put out of business. This kind of thing can happen to banks that are robbed of all their money. Either that or they need to cut back on services, stop giving out loans, raise people's interest, basically do whatever they can do to get a lot more money from you than they normally do.
