They constructed a legal argument that seems to have satisfied some lower courts in Ohio, but the "we did not see it so it did not happen" argument has a good chance of being ripped apart. Their argument in reality is "We now know it did happen, but we are not liable" and the Supreme Court may very well fault them for not presenting a realistic argument for the case.

Put it this way: If it were the owner of the bus company raping children, of course we would go after him for doing it. We would also go after the school district for employing an inept, sadistic, immoral, etc. company.

In order for a government entity to be held liable, it must have known about the condition and had adequate time to prevent it. If the bus driver claims he never saw it, then, as a government entity, the school district can not be held liable.
These laws are in place to protect the state's assets. Otherwise, people could sue for slip and falls, potholes, and a plethora of other fun things that non-government entities get sued for on a daily basis. Just imagine, my office gets about 100 claims for slip and falls a week, and each one alleges about 1 million dollars in damages. If you payed all those out, you'd be out 1 billion dollars every 3 years in slip and fall claims alone. Also, it should probably be noted that the State doesn't assume liability for School Districts, the counties usually do.

Those laws are not there to protect the state against frivolous claims, the courts can do that for the state just as easily as they can for any individual or business. However, under no circumstances is this reasonable. The rape happened 2-3 times a week for an entire year in a small school bus. Furthermore, when news of this finally gets out, the school apparently couldn't get much more out than 'You can't sue us for this'. Either the school or the bus company should definitely be sued for this.

Something doesn't seem right in this report... at least the local news report as the original link's dead. There seems to be no evidence, besides an emotionally disturbed boy admitting to a crime. I'm not sure if the little girl said anything or not either. Plus, the 'bus' driver drove a van with like seven seats, and heard and saw nothing. This all seems to be going off the word of unreliable sources. I'm not really sure the crime even took place, let alone whether or not the school should be sued.

My girlfriend * I swear I have one!!! * teach'd in a private school for some time and what she told me was awesome:
A kid decides to clog the toilets with papers, then flush it until the water flows everywhere. He draws grafitti on the wall "all that for FUN". The principal stops him, he goes to his office and call the parents. The parents pay for the damage and the kid comes back to school the day after with a big smile on his face.
Try to do that in a public school. I know the parents are responsible, but I'd estimate at 10% the parents that can't educate their kids, and that's 10% too much.

My homeschooling experience did not turn out so great, due only to the fact that my mom had cancer throughout grades 3-7(before she died, which is why we went to a private school after that), and she was trying to teach while going through treatments. She had taught school before she was married, and was good at it. All went well til she got sick. And then she couldn't seem to stand the thought that she just couldn't handle it anymore, and wanted to keep trying. I guess to sum up my whole thought here, I think home schooling is great as long as it's done well. Not everyone does it well, and those who don't, shouldn't.

I've met homeschooled kids who were socially inept and others who were were socially in tune. I went to public school most of my life but after my freshman HS year I had to drop out to save my sanity. Between the ***** HS drama and the pathetic curriculum there was nothing there for me. Getting the hell out of public school was the best thing I ever did. Public schools are nothing like the real world in my experience. I've had plenty of "real" jobs and like 5 years worth of university work and nothing I ever experienced in public school helped me prepare for what I have encountered in the "real world." I don't know if I would send my future children to elementary school but I definitely would not put their education in the public school's hands after elementary.

This is obviously an extreme case, but if you open the door to the school being responsible for your child's safety on the bus you're setting an easily corruptible precedent. What happens if kids are rough housing on the bus and one breaks an arm, should the parent then be able to sue the school district? Where is the line drawn between what the school is held accountable for? Just criminal acts? Any sort of of injury?
Here is what I think the school can be held accountable for when it comes to the bus, anything resorting from negligent or reckless driving that causes harm to the children, that is all, and that is assuming the school district hires the drivers.
Punish the boy as you would any minor who rapes or molests minors, but I really don't know if you have a case for suing the school over it. You can't just assume that the US has the most by default, especially considering that some countries don't even document many such cases of abuse either because they are legal, or because the law enforcement can't keep up with the crimes.
