And, instead of fighting it, they should apologize and accept responsibility for their mistakes. They are not setting a good example for other students and for other schools. If they get away with it, others will try the same thing.
there are so many ways they could have handled this. They could have detained the student and call the cops and the parents. And then asked for a strip search. instead they took the law into their own hands. It shows vindictiveness on the part of the school. No matter how frustrated you are, you have no right to take it out on the students. In cases like this, it just makes you look bad and takes you away from a position of authority where you can do so much more good. This is wrong on so many levels. First of all, this all took place because a girl who didn't like the plaintiff told the teacher that the plaintiff had a prescription strength ibuprofen. So, in other words, at that school, anytime a student says another student has contraband, a strip search ensues? Second, she was accused of having a headache pill, not heroin. Next, why the ***** is the school ordering a minor to disrobe? If they need my signed permission for her to take sex education, then they damn sure need it to make her get naked.
Her rights were obviously violated. I don't know a single person, conservative or otherwise that believes schools should be strip searching students. I've had some really big questions about all this.
First, Ibuprofen isn't a controlled substance. Its an over the counter pharmaceutical product. Exactly how does this constitute probable cause to search her.
Secondly, Why didn't they contact her parents. You can't even question a minor without parent and/or lawyer present.
Third, Were the individuals that performed said search qualified, certified, and/or authorized to enforce such an action? Last I checked a school doesn't have the privilege or power to perform the acts of police officers. If they weren't said individuals or even if they were consult the previous statement.
Lastly, Who the hell decided that schools had any such authority or power. This is ridiculous. This is a 13 year old honor roll student what the hell was going through their minds. - celotil, on 04/20/2009, -0/+9When I was in high school I used to get headaches fairly often, both regular pain and migraines. I asked on the first couple of occasions if I could have an aspirin or a panadol, and was denied because the school policy was not to give drugs to students.
I even had a note from Mum, and her direct verbal assurance to the Vice Principal that it was okay to give me pain killers, and they still wouldn't go against that policy, so I started bringing panadol to school.
I only got asked about it once, by a teacher who saw me taking a couple at a drink fountain.
I said I had a headache, and since it was school policy to not give me pain killers, I carry my own. She said I wasn't allowed to carry ANY medication. I said she wasn't allowed to be stupid, and went to my next class.

Instead of teaching our children to open their minds and explore the possibilities we want them to sit down, shut up, and fall in line. Or else. Robots and cogs in a machine. People wonder why our children are snapping? Why they are breaking? Its because we treat them like criminals for being individuals. We punish them for "crimes" that if they were an adult wouldn't even be a misdemeanor.
I'm not saying that the school shouldn't have some legal recourse to stop the true trouble makers. There is no reason for children to be flashing their gangs, explicatives, or causing general discourse but there has to be common sense. There has to be consideration. A school isn't a normal place of employment. It isn't your 9-5 desk job. You can't treat it as such. These aren't adults. They don't understand. Even if they say they do they have no idea how their actions can affect their lives but if you won't let them make mistakes then what is the point?
Parents aren't faultless here either. Parents need to manage their children, not schools. Schools aren't over glorified daycares. It is the parents fault for assuming that "someone else will handle it." You need to be active in your kids lives. You need to be present at school meetings. You need to voice your opinion. Why? So that it isn't your 13 year old son or daughter having some stranger asking them to remove their clothing without representation for some twisted and mutated form of justice.
This isn't rocket science people. We all pay taxes to have public services such as Schools available to your children. You have a say in how these institutions are ran. Its up to you to exercise those rights.
As for the school. You know you're in the wrong. You took an honor roll student with no prior history of disobedience and raped her. Maybe not physically, but mentally and emotionally. You stripped her of her power, her rights.. You didn't bother to include a parent. You were all so self righteous that you felt you had the authority to do as you pleased. Have you no shame, no sense of decency or morals. What if it was your child? What if it was you? Whats worse is that instead of owning up to the obvious mistake you decided to walk the line of self preservation. Instead of admitting that what you did was wrong, apologizing, and making amends you pushed this into our highest courts. Uphold a school official's right to arbitrarily order strip searches of young children, for a damn Advil. Pedophiles need good jobs. They have a lot offer the school systems. Let's face it, they have spent years figuring out what interests children. Maybe by setting up a legal framework in which they can strip our children down for any random thing, we can attract these people and their useful skill to interest children in learning! I should be a judge man!
