It would be different if she had won a suit in criminal court, and then tried to seek compensation in the civil courts. You shouldn't be denied the ability to bring a suit against someone in civil court either in the case of rape. (see comment)

She can obtain "justice" in a criminal court. That has never been disputed or challenged. But she has lacked the evidence to get a proper indictment, as I understand it. Basically, her case is so weak that is has stalled in the criminal courts. … (see comment)
