All isoHunt does is search indexes of torrent files. All torrent files do is contain metadata about the files that are being shared and the tracker. The tracker coordinates the communication between the peers, who are sharing the files with each other. isoHunt isn't violating anyone's copyright anymore than google is. In fact, the BitTorrent indexes which isoHunt searches aren't violating any copyrights. And whether or not the actual BitTorrent trackers are even violating copyrights is very much an issue in debate.
Sorry for the BitTorrent 101 lesson, but it is important because if they rule that isoHunt is somehow liable for the information that it indexes, say goodbye to every search engine as you know them, google, Yahoo, MSN, AOL, all of them. A ruling against isoHunt will mean that they are all responsible not just for the information on their own site, but they are also responsible for the content of every site they index... I'm going to say that again: every search engine would be responsible for all of the data on every site they index if the music industry has their way.
That would be a monumental decision: Did some blog use your copyrighted image without permission? Was that blog indexed by google? Sue google, they're responsible. Someone use a trademarked image? One of your copyrighted songs available on someone's blog? Sue Yahoo. Search engines would be forced to index only sites that they could be relatively certain would not infringe on anything, a tiny percentage of the web, mostly big corporation's web sites. - inactive, on 09/06/2008, -2/+54I've said this before, but...

It doesn't link to illegal material, it links to a program that connects people together and allows them to share data. The search engines don't have any illegal data. Nor do the trackers. The data, both legal and illegal, are all on user's systems. The files never touch the trackers or search engines. IsoHunt hosts text files that tell users which trackers they need to connect to, to get the files they want. The trackers then tell the users which other users to connect to. The users themselves have all the data.
Google links to pages that tell you how to make bombs. Those web pages tell you where to go to buy the ingredients, and how to mix them, etc. But YOU would have to make them bomb. Neither Google nor BombsRUs.com would be doing anything illegal, it would be you making the bomb...

1) Isohunt has a policy of taking off illegal content when requested to do the same by the relevant authority/copyright holders,
2) They are not hosting the FILES on their own server,
3) They are not posting .torrent files containing illegal files by themselves (ie they are posted by users)
and
4) They have a disclaimer/TOS clearly stating that they shouldn't be held responsible for the content shared voluntarily by the USERS.
Legally, no action can be taken against them.
(And I hope it doesn't get taken!)

Kind of like how you can go on any search engine and look up how to make meth or bombs, is it illegal? Yes! Do they have control over that? No, the end user is responsible. Should Google be shut down because you can search for illegal content on it? Of course not! They are not responsible for what other people put on the internet they are just a search engine.
Isohunt is just a search engine, nothing more. They are not responsible for whatever information there program swallows up at a users request. If they say that the search has to be filtered to remove illegal torrents BREIN, the CRIA, RIAA, MPAA, and other anti-piracy money-mongering groups would push to have all search engines filtered for illegal content.
If you want to see what it is like when the internet is filtered and stripped of all illegal content and anything some group doesn't like.
