I'm curious because this was passed unanimously 5-0 so it would probably have to be one damn good argument to why the FCC doesn't have the right to auction it openly. I'm also assuming that any argument that they could have made or make would basically mean the FCC would then be able to retract their right to own spectrums' since they received their spectrum in the exact same way. In other words it sounds like frivolous pointless suits that some idiot up high requested by yelling at his legal department.

I'm excited, I just hope this doesn't get butchered by lobbyists in the process of getting it passed through congress.
