- johndi, on 10/12/2007, -0/+12There are important words to keep you out of legal trouble in the US. It "seems," "may," "might," "looks like," and "it is my opinion." Of course that isn't bulletproof. He might have herpes isn't really a valid opinion, but a veiled accusation.
This may sound like you are weaseling out, but if you are honest with yourself without evidence, it IS opinion. Presenting it that way will keep you out of trouble in almost all cases. It also makes it easier to retract if you have to swallow your pride, and later admit that you were wrong. No, for spoken word there are slander suits. They can be very expensive too, and aren't necessarily covered by "Freedom of Speech." You have the freedom to stand in a public place and express your opinion, you don't have the freedom to stand in that same place and tell lies about someone. I hear you...A local around here was trolling a friend's blog and took a pretty nasty and humiliating flaming one weekend. Next week the perp. had filed a civil suit against my friend for "harassment." Totally mind-boggling. So you're a troll, reading the website actively, and then you're gonna sue for getting your feelings hurt.

I even once had a web forum and 2 people got in an arugment, calling eachother names, one person tried to press charges on the other, and somehow they said it was my fault for "owning" the web board, said it was my responsiblity???

It is excessive. Third parties cannot sue for libel, so this case will either be tossed out or resolved for the defendant with legal fees to be paid by Ligonier.
Ligonier, I should be able to sue discussion participants on various Internet sites for calling me a hairdresser and "probably a whore."
YES you can and should. They're insulting you and your character...Unless you actually are whore. THAT'S what libel is about.

NO. Libel and slander are by definition FALSE CLAIMS. You don't get to spread lies about someone else. That's been the law for more than 500 years. You can't say that "blah slept with a student" or that "blah failed me because I'm black" or anything else which impugns their character unless it's true.
You also can't be held responsible for comments made by others in your forums unless you moderate the board, and in that case, you must make an attempt to verify the truth of comments made when you are asked to do so. - satori3000, on 10/12/2007, -0/+1if it doesn't say who I am on my blog why would I care about what the law says. How would anyone charge me unless they logged me via my ip... even then I have a shared ban k of IPs so they can't find me easily... I'm sure I can be found given enough effort, but I can't think I'll say anything worth going through the hassle of trying to find me.

- icanrule, on 10/12/2007, -0/+0The same ideas that apply in real life should apply on the Internet. I would say that my president is a horrible president to his face so why should I post it on the Internet where the president can very likely read it and hold me liable for saying it.
The example they used was "Todd Hollis". Todd probably doesn't care what random people think of him but he doesn't want friends, family, co-works to know that rumor. The women who posted that information basically told his mother and his next girlfriend that he has STD's. I wouldn't like that.

I thought something with a cool name like "blog" has to be some kind of brand new media outlet and a revolutionary new form of communication and not just a chronically arranged series of articles.
Jesus this web2.0 thing is getting out of hand... blogs are nothing more than online journals... just like with anything else in written form, you can and will be sued for stuff you shouldn't be saying.
