It can't even be fairly interpreted by lawyers in cases which have no precedent of IP ownership. You can't copyright photos you didn't take and you can't stop people from photographing their cars.

If there is a fan site, embrace it. I have my doubts any large company has ever lost it's trademark rights due to fan sites. It isn't like the fan sites are passing off bogus parts under the brand name, or trying to mislead people into thinking that said fan site is an official [insert brand here] web site.

It reminds me of those movie 'FMV's people do on YouTube.. (I hate them a lot as they're stupid most of the time)
They put the picture of the car, and associate it with ton of random stuff, names, events, some that Toyota may not want to be associated with.

edit: One more thing...I hate the DMCA, it does not protect copyright holders, it is there to benefit large corporations. - locojones, on 11/16/2008, -2/+4The reason no DMCA takedown notice was issues was because this isn't a DMCA copyright issue, rather, it's a trade identity issue. And this website is profiting from advertising by hosting unauthorized images of the Toyota brand name and logo. And because those identities qualify as famous marks under 15 USC 1125, virtually ANY use not licensed by Toyota will be open to attack as infringing.
And I don't know where this argument that "it's OK to infringe your IP because it's free advertising!" comes from, but it's nothing but a naked rationalization and will get you laughed out of court if raised as a defense. - scoottie, on 11/16/2008, -0/+2if someone buys a toyota and then makes a wallpaper off of that its different then taking a image from toyotas site or some other site and making a wallpaper off of that
