- the legislative branch (Congress) PASSES laws
- the executive branch (Prez, VP, Cabinet) ENFORCES laws
- the judicial branch (federal courts and the Supreme Court) INTERPRETS laws
The judicial branch is now taking it upon itself to perform the function of the legislative branch as well, which is a clear breach of the separation of power as described in the Constitution. To the best of my knowledge, there are no extant laws (and no real precedent) to deal with this relatively new phenomenon. If we had a Congress worthy of its name, it would have bitch-slapped the judges in question into the next decade for basically usurping the powers reserved for the legislative branch. - inactive, on 02/05/2009, -1/+6oh wow judges abusing the law to support big business.. why do they even bother calling themselves judges.. might as well not just be determined guilty without proof.. oh wait they are doing this already?..

Where as the Judicial branch are appointed and voted in by the Legislative branch.
