- infectedRoot, on 10/12/2007, -0/+4Ticketmaster has taken the pics down, but thanks to google cache, it reveals that ticketmaster indeed still has the image on their servers!!!!

*** gasp *** - mattrmiller, on 10/12/2007, -0/+4The photo owner should charge Ticketmaster with a convenience charge :)
- spling, on 10/12/2007, -0/+4Am I the only one who is thinking "good on ticketmaster for removing the image when the copyright infringement was brought to attention?"
- kali25, on 10/12/2007, -0/+2WOW, I just read the terms of service and she still did own the copyright, that is amazing. Guess I was wrong. Ticketmaster should be sued, I am sure this is done hundreds of time, some lazy webdude at Ticketmaster just rips the image, he/she is in hot water now.
- Dingle, on 10/12/2007, -0/+2Ya this is kinda ironic. We all steal movies, TV shows, music, pictures for our own uses and think its ok. But when a huge company does it to us we throw the red flag.
- spadin, on 10/12/2007, -0/+1Who the hell is Colin Meloy anyway?
- nymphetamine, on 10/12/2007, -0/+1whats next? are they gonna start stealing pics from peoples myspace pages? i wouldn't be surprised.
- velocipenguin, on 10/12/2007, -0/+1Ticketmaster is evil.
- yorkie, on 10/12/2007, -0/+1After a couple more recent examples of this, we have an new Flickr group for this kind of thing .. http://www.flickr.com/groups/ripoffs/
- gmp3, on 10/12/2007, -0/+1Excuse me if I'm wrong, but every image on Flickr is only copyrighted by Creative Commons licenses, which, i do believe gives Ticketmaster full right to use it in whatever they want, that's how i understand it, if your a lawyer and know differently, please fill me in, that's one of the reasons i don't use Flickr so much anymore.
- Nothlit, on 10/12/2007, -0/+1gmp3, each individual Flickr user can determine whether to license his or her images under Creative Commons, or whether to reserve all their rights under traditional copyright. In this case, the original photographer had reserved her copyright.
- MattZed, on 10/12/2007, -0/+0good to see that ticketmaster took it down.
- n8agrin, on 10/12/2007, -2/+2"That's hilarious. What's more hilarious is her threatening email of legal action. Somehow, I doubt Ticketmaster is that worried about some little girl taking them to court over 1 jpeg."
Have you ever had a photo stolen and used by someone for their own profit? Or a website layout ripped that someone else gets credit for it? Imagine if this is how you make a living and you are getting nothing for someone using your work, wouldn't you be a bit upset?
You can't make blanket statements about people's actions (ie going off to download Family Guy) and claim they are hipocrits unless you know they are doing that specifically. In this case it's a blatent disregard of the artist's ownership of the work. They (Ticketmaster) did the right thing by taking the photo down and the artist did the right thing by writing them a letter asking them to take it down, or face legal consequences... That's how business gets done. - djspade313, on 10/12/2007, -0/+0Well they pulled the pic... but I hope she still sues their asses for everything she can get.
- inactive, on 10/12/2007, -0/+0Big business should know better, simple as that. They have a lot more on the line. Like suing McDonald's for a million dollars for spilt coffee only because you know they got the money. You wouldn't sue your friend or local diner for that. Whatever website maintainer put that on there should be disciplined or fired for potentially causing a lawsuit for the company.
- chrism1128, on 10/12/2007, -0/+0"My aim in posting this is not to raise any angry mob justice towards Ticketmaster "
- - - Mine is, so let's burn it down!
(figuratively) - masoncooper, on 10/12/2007, -0/+0Drood:
That looks like a standard copyright takedown notice. See how she affirms under penalty of perjury that she is the legal copyright holder. That was most likely a form-letter she filled out to properly notify ticketmaster. - mdunmore, on 10/12/2007, -0/+0There is a huge difference in personal use and making money off someone else's work. And you can bet that if you started making money off the movies, TV shows and music that you stole the owners of those things would be on you in a hurry. This IS a big deal!
- jord, on 10/12/2007, -0/+0looks like they've already removed it?
- Dingle, on 10/12/2007, -0/+0wow. You should be proud that ticketmaster used your picture instead of ready to sue them.
- Bigbro69, on 10/12/2007, -0/+0Good on them for taking it down promptly, I don't see why you're complaining when they took it down...
- SuperMoonMan, on 10/12/2007, -0/+0Hmm. I'm not sure about this one. Isn't this not good for the whole idea of freedom of everything and such? You know, free content for everyone to use, indie music, podcasting...the whole take back the media thing? Shouldn't it be almost a good thing that Ticketmaster took the images of an amateur photographer (if this is an amateur photographer, anyway) and used them for their site? Maybe I'm just tired...
- jollyfats, on 10/12/2007, -0/+0Offtopic related to McDonalds comment: Please check out the real story behind the coffee spill lawsuit. There's a lot more to it than what the popular press or comedians mention. And I don't think the lady in that lawsuit actually got the money (at least the MM that was awared to her). Random related site (google search): http://lawandhelp.com/q298-2.htm
- kali25, on 10/12/2007, -1/+1She did not own the copyright, Yahoo did. I but if you read the fine print that it says that any content you post on Flickr becomes the property of Yahoo, Inc. I could probally go find it but I am lazy.
- shiftless, on 10/12/2007, -0/+0That users images weren't under CC licence.
- stickyboot, on 10/12/2007, -0/+0To bad, but at least it apears like they removed it.
- scanman20, on 10/12/2007, -1/+1Ticketbastard
- polvo, on 10/12/2007, -0/+0Drood - love your sexist remarks calling her a "little girl".
Do you know her? Then why do you assume that she is infringing others copyrights?
Talk about blaming the victim. - n8agrin, on 10/12/2007, -0/+0this isn't the first time I've seen images ripped from flickr. there have been some floating around that have ended up on international websites, and good luck getting removed.
- isoprophlex, on 10/12/2007, -0/+0they are and have always been crooks... them and Clear Channel.
- ryanonroam, on 10/12/2007, -0/+0From personal experience using the Ticketmaster system it is the artist's booking company or label that uploads the pictures, tour dates, bio & all that stuff. You actually think that Ticketmaster would take the time to do all that crap themselves??? Find out who their booking company is and place the blame there.
- freonchill, on 10/12/2007, -0/+0ironic - the mpaa used to just send 'cease and desist' and now they just sue people
maybe we as customers and citizens should take the corporate citizens of the world's view and just sue them for more than they are worth when they screw up...
brings whole new meaning to "class action lawsuit" - CrazyAntal, on 10/12/2007, -0/+0"Hmm. I'm not sure about this one. Isn't this not good for the whole idea of freedom of everything and such? @supermoonman: You're obviously new here. Yes, copyrights are generally a Bad Thing (TM), with an Evil Factor of 6.5. Evil Corporations (TM), however, have a much higher Evil Factor of 666, so when a copyright can be used to hurt an Evil Corporation, that's a Good Thing (TM). - cyclotron, on 10/12/2007, -1/+1Apparently you guys think the CEO at TicketMaster ordered company policy to be to steal Flickr images. I, on the other hand, think that the person responsible for creating those events stole the image on their own accord... making this not a huge scandle but the embarring proof that too many amatuers are possing as professional web designers or content creaters.
- dmsteg, on 10/12/2007, -0/+0To those giving kudos for ticket master taking down the photos... the page says the event doesnt exist in theire database and looking at the screencap on the origonal page, the concert took place on the 21st.
So it's not so much that Ticket Master made good on theire wrongdoing as much is the page just no longer exists. - 1ivewire, on 10/12/2007, -0/+0I believe by reproducing a Ticketmaster web page with concert and ticket information on Flickr, Kathryn Yu has now committed copyright infringement. Well maybe not, but it would be cool if she did.
- bluefire0728, on 10/12/2007, -0/+0An issue dealing with:
- copyright infringement
- a Flickr user
- Colin Meloy of The Decemberists.
Wow, if I could, I'd digg it 3 times over. - noeljohnhoward, on 10/12/2007, -0/+0w/e
- acomj, on 10/12/2007, -0/+0This happens all the time.. I run a photo site and my pictures are routinely cross-posted as backgrounds for blogs etc, I can find those easily. However if someone copies the image changes the name, the chance of me finding it are slim. Everyone has not been an ad so I don't care.
See this (scroll down near the bottom to the A Personal Approach to Copyright section. Basically its hard to prove you own the photo and didn't get it from somewhere else. Easier with film (I have the negative!).
http://philip.greenspun.com/panda/images - TylerC, on 10/12/2007, -0/+0I dont really think its stealing if the images are public.
- SystemError, on 10/12/2007, -0/+0i see that as props if they use a pic i took and posted openly on the internet.
- Aeplus, on 10/12/2007, -0/+0If the photographer were to be awarded money, would she give Colin a piece of the action?
- Flashman, on 10/12/2007, -0/+0"My aim in posting this is not to raise any angry mob justice towards Ticketmaster "
(pre-emptive acknowledgement of the Digg effect?) - ryanonroam, on 10/12/2007, -0/+0How many times do I have to say this before you people listen? Booking and promotional companies upload all artist information and images to Ticketmaster. Yes, Ticketmaster sucks, but this is not their fault.
- thetruth, on 10/12/2007, -0/+0Copying IS NOT stealing.
Now, let the first person who has never illicitly used protected information cast the first stone. Thought not.
Next. - inactive, on 10/12/2007, -0/+0Here is the comment I posted on Kathryn's Fliker site:
I have posted my copyrighted work on the Web for over 10 years. I have had lots of cases were companies big and small have used my work without my knowlege or permission.
After a few years of sending a "cease, desist, and remove" e-mails I changed to sending them an invoice for the use of my work. Most of the time the offending site would just take my work off their site and ignore me....but sometimes they paid.
I got $400 from a major media outlet who used my work. When I got the check I went out and bought a bunch of wine. I marked each bottle with a small piece of tape so when I drank that bottle it was "sweeter" knowing that it was wine bought by a company that stole my work and didn't get away with it.
I would suggest the direct invoice approach. Remember...when lawyers are involved ususally the only people who get paid are the lawyers! - JackDoyle, on 10/12/2007, -0/+0So... if someone steals my car and I run an ad in the newspaper asking for it back and they return it to my driveway and leave without me seeing them does that make them less guilty of a crime?
- carguy84, on 10/12/2007, -1/+0meh
- smoothoperatah, on 10/12/2007, -1/+0that sucks.
- Drood, on 10/12/2007, -4/+3That's hilarious. What's more hilarious is her threatening email of legal action. Somehow, I doubt Ticketmaster is that worried about some little girl taking them to court over 1 jpeg.
I want to see this case go to court. I really do. It'll be comedy gold!
What's the betting our friend rattling her sabre has, in the past, violated copyright herself? (Anyone who says they've never violated a copyright is a liar.)
I love the self righteous indignation from people over this sort of thing, who after posting how horrified they are, probably head off to Mininova to download the latest episode of Family Guy... -
