"According to the Swedish Code of Judicial Procedure (Rättegångsbalken, SFS 1942:740) Chapter 35Section 1 the court shall, after evaluating everything that has occurred in accordance with the dictates of its conscience, determine what has been proved in the case. The provision contains the principle offree sifting of evidence (fri bevisprövning), which entails free submission of evidence (fri bevisföring) and free valuation of evidence (fri bevisvärdering).
There are some exemptions from the principle of free sifting of evidence. The court shall, for example,reject a proof if it finds that a circumstance that a party offers to prove is without any significance inthe case, or if an item of evidence offered is unnecessary or evidently should be of no effect. The courtmay also reject an item of evidence offered if the evidence can be presented in another way withconsiderably less trouble or costs.
In other words, the principal rule entails that any proof, without limitations, can be presented beforethe court and the court is not bound by any regulations when determining the value of the item of evidence. The Swedish legal system does not prescribe that it is forbidden to present an item of evidence which the party has got hold of while breaking the law. Neither is the court prevented fromascribing such a proof a great value."

They are not stealing copyrighted material or even hosting the files. They just make it easier for pirates to get to what they want. In there country this is not illegal. They have been hacked and ddos'd, which is illegal and they are taking legal measures against those who performed the illegal acts.

Merely providing links to something is not illegal in Sweden, however hacking, ddos'ing etc is illegal in pretty much every single country on the planet. Where did I say that? How about sticking with a conversation thread? I just took his unbelievably narrow minded definition of "customer" to its logical conclusion.
I HAVE copyrighted material. How about you? I HAVE worked on products that were both purchasable AND free. How about you? The law in America is also abused, and it's a far more destructive result. While I'm probably not in a position to read such things, I don't think I've ever heard stories about Swedish police abusing this law. I've read countless American cases that result in a critical piece of evidence being discarded because the proper paper work wasn't filed.
IMHO, I'd rather have the Swedish police be able to enforce the law by obtaining criminal evidence however they deem necessary than have criminals be able to hide behind the opposite. Let's not forget that we're talking about CRIMINAL EVIDENCE here -- not just any ol' things you might be hiding in your closet. - phnx0221, on 10/10/2007, -0/+11To the recording artists who put so much time and effort into making their music, and then to only get a 1% payment out of the CD sales (or something like that, I'll look it up for sourcing, but I do know that it is an incredibly small amount), it seems like those very same recording companies are giving away their music for free. Except, they're not. And the money made from those $18.99 Cd's, are for the most part, going straight to those recording companies, not the artists.
Piracy allows for art to be seen and heard, by millions of people. And it isn't contingent upon Press Releases, MTV spots, or paid radio play. If people like it, they like it, listen to it, and will go to their concerts where higher percentages of the money made actually does go to the artists.
This is just repeating the obvious, but the media companies only have their panties in a bunch over the immorality of theft, because they're the ones who are being robbed of their millions of dollars. I think privacy is worth something and I think requiring probable cause is a good thing, though it could be loosened a bit... you should have to answer if you searched a place and found nothing.. you should have a clear answer as to WHY you did it in the first place.. if you have no reason why you did it and nothing illegal was found, you should be held accountable.

Suppose I WERE downloading copyrighted material without permission. How the hell does that make me a childish crybaby? The only thing I'd have to complain about either way are ignorant attitudes like yours. The people that whine and complain are the ones that DON'T get things their way...as in media corporations that can't control and fleece the market like they used to, and sympathizers such as yourself.
Do you honestly think I'm complaining that my personal libraries are free of DRM'd content, or that I'm not locked into any proprietary platforms, or that I'm free to spend my cash however, wherever, whenever, and on whatever I choose? They provide a service, if people abuse or misuse the service for things morally objectionable then are they really responsible? Just like a tier 1 internet backbone provider is not expected to police their tubes...
