The court then evaluates what will be allowed based on their own discretion. The evidence we are talking about here (hacked emails) is a type that has been legitimately presented many times in Sweden over the years and I'm willing to bet their will be NO problem using it in court.

This is a known group of people involved in illegal activity trying to use the legal system. Stealing emails and using them is illegal, but using emails stolen and released by an unrelated 3rd party are usable. The only way the companies will be able to avoid the emails would be by claiming and proving that TPB helped in or knew of the hacking done at MD, which they probably didn't until they were posted.
This is the way it works in all countries, USA included.
