No, Kevin, you are under no legal obligation to remove criticism of the way you handle cease and desists. Your site contains a lot of profanity, so that alone is no reason to start removing comments and entire stories with perfectly normal comments. The choice to try and silence your users for criticizing you is your choice and one that brought people up against you. You could have created a story right away, explaining why you think you have to remove the key. That would have concentrated the criticism in one place. If you do something that the MPAA wants, you are going to draw some fire from your users. It's the way that you deal with that criticism that makes or breaks you. Wasted over a hour :( - bcope16, on 10/12/2007, -0/+11That's true. Artist usually don't get paid squat for recordings. Just check to see which artists are pissed about it. Bands like Metallica and Dave Matthews Band, who have such a large share of profits on sales that they say something and make you think all artists must be pissed. The truth is that until a band sells a million albums, they aren't going to see $$ from sales. All of their money is made from touring. And even a portion of that goes back to the record companies to pay for equipment purchases/rentals/hiring.
So, what you normally see is that 80% of the musicians WANT their music to be shared and spread, because they just want more people at their shows. Check out bands like Steadman, who give their music away for free now that they can. They just want to fill seats and get their music out there.
If you think that the RIAA is fighting for artists, you are sadly mistaken. They are fighting for the people who can give them money or clout. These are the top %1 of artists and then the Recording companies. The rest have to sit back and just hope their music gets traded, because they can't say anything to promote the sharing of their music without violating contracts, or having to worry about getting their deals revoked.
The thing that I find most humorous is the fact that iTunes has made everyone to believe that $.99 is a good price to pay for a song. Hello! We're paying more per song this way, getting a worse quality product in most instances, and there's no paper cost to the companies. Where the digital cost is far cheaper. We should be paying .49 a song at most now for recording companies to still make a killing. And now we'll get drm free stuff for even greater expense to us, while the companies selling it will actually be SAVING money since they won't have to put drm on them. That's hysterical. Great Spin from the industries. It's like Baskin Robbins selling you a scoop of ice cream for .20 more if you bring in your own cup and spoon. Awesome! Where do I sign up!!
Not to mention all this time, the Recording industry is going to promote bands that file in line with their policies because it doesn't matter if the bands are really that good, only that they'll follow their rules and because of the lack of places to hear "Unknown" bands, they'll still sell the albums of the crap bands that they can enlist.
The recording industry sucks. It has always been a crappy industry and the digital age isn't changing it, it's just making them more money, all the while they get to put a spin on it making it look like they are suffering. See if we can create enough buzz to take a noticeable bite out of the first week movie sales. Ideally it'd be some movie that would normally be a big hit with the digg demographic. Spiderman 3 would have been a good choice IMHO.

It seems more likely to be a trade secret and if that is the case then arguably the secret was out long before it was posted on Digg. As a result, the posting on Digg did not cause any damages. Damages are an essential element to any lawsuit. Without damages, you cannot sustain an action in court. It appears that AACS has no damages from this posting as the number already exists on 600,000+ locations on the Internet according to Google.

Putting the key to use may be a long and difficult process, but all it takes is for *one person* to do it and post a torrent somewhere for the pirated file to spread to everyone who's interested. Go to any torrent site, type in "1080p" and you'll find full-resolution rips of every HD-DVD/Blu-Ray movie yet released, for free. The only difficult part is the 12-hour wait for the download to finish, and occasionally figuring out how to play whatever bizarre codec the pirate has decided to encode the video with.
