all isp's (other than speakeasy) have clauses in the TOS or Contract or whatever you want to call it that does not allow you to share your wifi; i know that comcast's goes as far as to say that you are also limited to 5 users and all have to be residing w/in the same residence (or in terms of apartments, same unit) - double0shithead, on 10/12/2007, -0/+0kind of funny how many spots have been added today while the site's been on the digg homepage. I don't have the money to fight in court :S. Even if you restrict what they can do, as long as they have a connection to the internet, anything can happen. For me, I think im just gonna leave the WPA2-PSK AES-CCMP encryption enabled with my OpenSSH FreeBSD Authenticating Gateway. (Can't wait for OpenSSH 4.3 though!)

I thought about doing this in my new neighborhood. Verizon just came through and laid fiber for their FiOs service. As soon as they fire it up, I will be dropping Time Warner Cable and I will have 15mb down and 5mb up! I could share my bandwidth and not even notice a dent. No. Simply sharing your WiFi connection is not illegal as defined by any state or federal law.
Now, accessing someone else's network without their knowledge or permission is definately illegal - that's covered by the Computer Fraud and Abuse Act.
Sharemywifi.com's whole purpose, though, is to connect people who are explictly giving their permission to share their WiFi access with their neighbors and others. It's a huge difference than if you were just taking their access without asking.
Be advised that your provider's Terms of Service (TOS), however, may be another matter. 1. They don't pull the lines. They have these little cap things that can easily be removed and 'unpulled'.
2. So you can't let your wife use your computer?
Can't let your visiting friend use your computer?
Can't let a friend use your laptop outside your house with wifi?
Can't let your neighbor borrow your laptop and use your wifi?
Can't let you neighbor use his own hardware to access your wifi?
Can't leave the connection open and just not say no to anyone?
Can't let anyone use it and give them permission
Can't sell and sublease the connection?
Notice how gradual it can really be. I doubt they have ever "pulled anyones connection" before.

PS If anyone ever actually takes the RIAA or MPAA to court and fight the charges against them, they will find that if they say they had an open connection and they didn't do it, they can't loose a lawsuit. Otherwise your ISP would be responsible for your illegal actions. (Not that I wouldn't put it past the RIAA and MPAA to try to sue ISP's for not stopping copyright infringement.)
