- rubberpants, on 10/12/2007, -3/+41From the article: "The music industry's over exaggerated fears of piracy are driving the legislation, just as they did last year. "New radio services are allowing users to do more than simply listen to music. What was once a passive listening experience has turned into a forum where users can record, manipulate, collect and create personalized music libraries," said Sen. Feinstein. "As the modes of distribution change and the technologies change, so must our laws change."
Wrong Senator, it's the RIAA's business model that must change. - HMTKSteve, on 10/12/2007, -2/+30If they are so concerned about people recording things off of the air there is only one solution...
Get rid of all broadcasting!
Stop sending albums to radio stations. Tell them not to play your music to all of those pirates out there!
Come on RIAA, take the next "logical" step! - ChaosIncarnate, on 10/12/2007, -10/+33When will people figure out "This was first." posts just get dugg down consistently?
- littlebylittle, on 10/12/2007, -10/+30The RIAA is like the Scientologists. THEY WILL NEVER GIVE UP AND THEY WILL SUE ANYONE IN THEIR PATH!!!!!!!!!!!!!!!!! IT'S A BILLION YEAR WAR AND THEY ARE PREPARED TO FIGHT IT!!!!!!!!!!!!!!!!!!!!!!!!!!!
- Uranium118, on 10/12/2007, -0/+11They are just pissing off honest people. Pirates will find a way around it....
- alricsca, on 10/12/2007, -0/+11You know what galls me, living in the state where a so called Democratic senator supports this kinda of crap. Let me tell you she is making a mistake. There is a large enough group of people in this state who hate these actions so much that when a certain Governor get set to run for Senator she is finally going to find herself out of office. This woman has managed to get herself entrenched with the support of the ex hippy movement here for actions she took decades ago. That generation is too out of touch to really get upset over this but take a popular candidate, a large Republican minority, and a pissed off new generation and that spell dynamite in the trenches. Let me say very few deserve it as much as she does. Her and Ted Stevens should hook up, they are already in bed together.
- Rosco, on 10/12/2007, -0/+10C'mon, post what everyone wants to know. Who are the senators the introduced this bill?
Sen. Lamar Alexander (R-TN), Joseph Biden (D-DE), Dianne Feinstein (D-CA), and Lindsey Graham (R-SC) - jcounterman, on 10/12/2007, -0/+9actually, recording satellite and digital signals can and is used for Fair Use. So by denying the right to record, you are taking away the right of listeners (granted by law). You don't ban cars because some people use them to speed, and you shouldn't ban recording when people can use it for legal purposes.
- Clark3934, on 10/12/2007, -0/+9...try with more democrats?
- Unrealious, on 10/12/2007, -0/+9Too bad Fred Rogers isn't around anymore to testify.

Mister Rogers and the VCR
During the controversy surrounding the introduction of the household VCR, Rogers was involved in supporting the manufacturers of VCRs in court. His 1979 testimony in the case Sony Corp. of America v. Universal City Studios, Inc. noted that he did not object to home recording of his television programs, for instance, by families in order to watch together at a later time. This testimony contrasted with the views of others in the television industry who objected to home recording or believed that devices to facilitate it should be taxed or regulated.
The Supreme Court considered the testimony of Rogers in its decision that held that the Betamax video recorder did not infringe copyright. The Court stated that his views were a notable piece of evidence "that many [television] producers are willing to allow private time-shifting to continue;" it even quoted his testimony in a footnote:
Some public stations, as well as commercial stations, program the "Neighborhood" at hours when some children cannot use it ... I have always felt that with the advent of all of this new technology that allows people to tape the "Neighborhood" off-the-air, and I'm speaking for the "Neighborhood" because that's what I produce, that they then become much more active in the programming of their family's television life. Very frankly, I am opposed to people being programmed by others. My whole approach in broadcasting has always been "You are an important person just the way you are. You can make healthy decisions." Maybe I'm going on too long, but I just feel that anything that allows a person to be more active in the control of his or her life, in a healthy way, is important.
—Frederick Rogers, [3]
The Home Recording Rights Coalition later stated that Rogers was "one of the most prominent witnesses on this issue."
Rogers had been a supporter of VCR use since the very early days of the VCR -- in his final week of episodes of the original run in 1976, Rogers used a U-Matic VCR to show scenes from past episodes, as a way to prepare viewers for repeats that would begin the following week. - nixonrichard, on 10/12/2007, -0/+8People who voted for democrats must feel like they just bought a lemon from a high-pressure used car salesman. "Better vote for a democrat or some big mean republican who will take away your rights will get elected!" Vote libertarian, vote green, I don't care . . . just don't vote for this crap again.
- mbondr, on 10/12/2007, -0/+7I don't know about you guys, but we here are awash in content. The whole fricken world is awash in content. 99% of the stuff they're talking about is garbage. For instance I could care less if I never hear another Modonna song again. They can keep "Lost". If there's anything worth looking at, it'll turn up on Netflix eventually. Turn off your cable and avoid the whole issue. Go outside and check out the sky!
- megaloid, on 10/12/2007, -0/+7I like Sen. Feinstein. She's an ardent proponent of every sort of gun control legislation, yet has a special permit to carry a firearm in D.C., where the local black peasants who do the same go to jail. She's a real champion of the people, just like the rest of Congress.
- mastershake1, on 10/12/2007, -0/+7It's sad, pathetic really, that the culture industry (RIAA,MPAA, etc) have so little confidence in their products that they think the only way to stay profitable is through government restrictions and subsidies. These companies need consumers more than consumers need them. You cannot treat your customers as criminals if you expect to be profitable. The BEST thing that these companies could do would be to all the market to flourish and let the consumer electronics companies produce cool stuff with cool features at lower prices. Then customers will be more willing to buy content to go with the technology. None of this DRM infested garbage like HD-DVD or Blu-Ray, which is expensive, clunky, and in short supply.
I have little hope that Congress will stay out, given that both parties have shown extreme willingness to bend over for the record and movie companies at any opportunity. Please write your Congresscritter and let them know that should this law go into effect, you will do whatever you can to NOT purchase new, DRM laden technology out of protest for the restrictions, nor will you purchase any content to go with it. - MadMan459, on 10/12/2007, -0/+7I'm getting my thoughts together to write both of my Congresspersons, both in email and snail-mail. If anyone is serious about wanting to stop this kind of legislation, you should be doing the same. Just remember, keep it short, clean, respectful and to the point. Spell check and make sure you are listing your reasons for killing this bill in an intelligent, orderly manner.
forums like this are a good way to get the word out, but unless you contact your congresspersons directly it won't amount to much. - nixonrichard, on 10/12/2007, -0/+6Joe Biden can suck my balls.
- Sixcolors, on 10/12/2007, -2/+8Mr. eddieo after very careful consideration, sir, I've come to the conclusion that your article title sucks.
- inactive, on 10/12/2007, -0/+6Doesn't matter Us > RIAA/MPAA every time.
- zanzzz, on 10/12/2007, -0/+6One way to help fight this and similar anti consumer and anti privacy legislation is to support the EFF, Electronic Frontier Foundation.
http://www.eff.org/ - iluvhatemail, on 10/12/2007, -0/+5this was my letter to Senator Feinstein. I suggest all Californians do the same (http://feinstein.senate.gov/email.html)
Good Afternoon Senator Feinstein,
I am writing in regards toward the Platform Equality and Remedies for Rights Holders in Music Act bill, also known as PERFORM. As a citizen of the United States and a resident of the state you serve, I feel it is my obligation to tell you that your constituents do not approve of your support behind it.
This bill would be a major step towards restricting the freedoms granted to us under the Audio Home Recording Act of 1992. The main purpose of PERFORM would not be to deter pirates (as current encryption/DRM methods already show do not work), but make a majority of us honest, hard working people, criminals under the law.
A similar bill had already been defeated, not because of some technicality, but because a bi-partisan majority saw that their people do not approve of this, and that they must fight everyday to continue to keep the freedoms of our fathers and those before them.
Please stop trying to reform technology in a way that will inhibit it and prevent the United States from retaining its leadership throughout the world. These are the times we need to be more open minded and not so quick on the trigger to restrain these simple pleasures people enjoy.
Do not side with Big Business, instead I invite you to change your mind and follow the path that is best for all people. The freedom of information and the ability to transfer it and retain it is part of what makes America great. Thank you for your time.
Sincerely Yours,
[iluvhatemail]
El Monte, CA" - nixonrichard, on 10/12/2007, -2/+7Chairman Mao (the one from China) once said (translated):
"I like conservatives. A conservative is a whore who can admit she's a whore. A liberal is a whore who pretends to be a virgin." - CraigJ, on 10/12/2007, -8/+13Never?
- 3dom, on 10/12/2007, -0/+5It is physically impossible to prevent recording of an audio transmission, whether it is by radio, internet, or cable. As long as the source renders the audio feed to speakers, the audio signal path can be intercepted and recorded by various means. As soon as you put audio outside the computer it is vulnerable to recording mechanisms
- kremvax, on 10/12/2007, -1/+6It could be worse. You could be living in a state where one of the republican senate authors of the bill lives.
- pauleku, on 10/12/2007, -0/+5I think the RIAA will go so insane that it will implode and both the universe and time itself will end. THEN and only then people wont be able to copy or distribute cds they bought.
LOOK RIAA!! IM RECORDING RADIO MUSIC ONTO TAPE!! holy sh*t thats GOTTA STOP! - OriginalLucid1, on 10/12/2007, -1/+5Joseph Biden is not a real Senator. He just plays one on T.V.
- shadus, on 10/12/2007, -2/+6Yeah, I setup a mythtv box. Was exceptionally easy and from what I can tell that is normal unless you pick off the wall hardware for it, I expected much worse based on the number of complaints I read before I started.
What's the quote from Adminspotting? "Choose rotting away at the end of it all, pishing your last on some miserable newsgroup, nothing more than an embarrassment to the selfish, ***** up lusers Gates spawned to replace the computer-literate." - neeyo, on 10/12/2007, -4/+8Your senator doesn't have much to worry about if all you're going to do is make a post on digg. Yeah, I bet she's quivering in her boots. Get off your lazy ass and so something about it if it bothers you so much.
- videoCT, on 10/12/2007, -0/+4well, I guess we finally caught bin Laden, because it looks like Congress has time to write silly bills!
- alricsca, on 10/12/2007, -1/+5For your information Neeyo I did vote against this senator. I voted for the Green party candidate. What exactly about my posting on Digg makes you think I am not politically active? You know it is possible to read and post on blogs and still be active in the real world. In fact, doing both is part of being politically active. Oh wait, maybe you are just trolling for a flame war.
- Ryosen, on 10/12/2007, -0/+3The RIAA/MPAA know all too well that Americans have a very short attention span. Once passed into law, any so-called boycotts will last all of 3 weeks before some..OMFG!! THE NEW BRITNEY SPEARS CD!!!!
- PopcornDave, on 10/12/2007, -0/+3How is this even going to be implemented? I mean I can rip and XM or Sirius stream via Audacity and cherry pick what I want out of it. If I'm paying for their service, and record something from output, how the hell is this going to stop me?
- inactive, on 10/12/2007, -0/+3Geekee we all know copyright laws in the USA do not work, at all. It protects large companies way too much, and not the small artist.
- bigdt87, on 10/12/2007, -1/+4I want to choke Lindsey Graham. I dont know, theres just something about him...
- pabster, on 10/12/2007, -0/+3It is the nature of monopolies and cash cows for big industries.
Look at other areas. Cable, for example. Telephone. Electricity.
All these jokers use millions in dollars under the table to Congress to influence votes and buy protection for their cash cows.
Why change when you don't have to? - deesnutz, on 10/12/2007, -2/+5I'm a Democrat. And if Joe Biden thinks he could pull this ***** and become President in 2008. He is surely mistaken. I think he should change his decision. If not it would cost him his presidential bid. I'm for one will work in my circles to make sure it doesn't happen. Joe, wtf were you thinking?
- Clark3934, on 10/12/2007, -2/+5Interestingly enough, the is the first article not to make careful mention that it is the "New Democratic Congress," not the old Republican do-nothings.
- fitchmicah, on 10/12/2007, -1/+4my friend really really likes joe biden, and this is why I disagree with him
- conna, on 10/12/2007, -1/+3Flush the morons out of the house and senate that vote for this kind of *****.
- spiffytech, on 10/12/2007, -0/+2Geekee, as the article states, the Audio Home Recording Act of 1992 gives consumers the right to make noncommercial analog and digital copies of broadcasts, so recording satellite radio is not a copyright violation.
- atbnet, on 10/12/2007, -0/+2Here's an idea, let's put our technology-minded heads together and form some sort of e-mail that we can all send to our respective senators.
I'm sick of the MPAA and RIAA looking to Congress to bail them out of their archaic business model since they aren't willing to adapt.
This is capitalism at it's finest. Instead of survival of the fittest, just look to Congress to bail you out if your business model ***** sucks.
God I hate the RIAA and MPAA. - megaloid, on 10/12/2007, -0/+2He won't. There's nothing in it for him.
- OriginalLucid1, on 10/12/2007, -0/+2Barney the Frank has got Joe tied down to an exclusive long term ball sucking contract. So you my friend, are out of luck.
- erotocrat, on 10/12/2007, -0/+2"However, they would be prevented from automatically cherry-picking all the Shakira songs from the services." I think this is a good thing because why would I want to record any Shakira songs anyway? The record industry is wondering why its cd sales are stagnating. It is because people like me are fed up with the kind of sub generic music that they are trying to sell to us. FYI, the music played in car commercials is far better than anything on MTV (sic).
Now regarding recording songs, we will always find ways to record music via 3rd party software, hard drive swapping, Ipod swapping etc. - SoxFanNH, on 10/12/2007, -0/+2LMAO what a joke Congress has become, just wasting time and listening to whoever has the money...
- meatwad64, on 10/12/2007, -0/+2this isn't a democrat/republican issue. Don't forget 2 republicans were part of this bill as well. This is about the lobbyists controlling our senators. We need to get these 4 people replaced asap.
- pabster, on 10/12/2007, -0/+2What a surprise. 2 Democrats, including that joker Biden, sponsor a bill like this. Just goes to show who the money is flowing to under the table.
As some others have already said, it isn't laws that need to change, it is the business model and attitude of the industries. And specifically those crooked organizations who purport to represent content producers and owners but are really just bloodsucking bats. - positron, on 10/12/2007, -0/+2People already are.
http://www.freestateproject.org - OriginalLucid1, on 10/12/2007, -0/+2What is this "sky" thing you are talking about? Do you have an URL?
J/K - afruff23, on 10/12/2007, -0/+2I wanted to record the Internets but now this bill won't let me. STOP THE BILL!!
