I guess the RIAA will believe that their lawyers statements are subject to copyright and that the poor sturggling lawyers wont get any royalties if the recording freely available?

Whoever is allowed to actually film it can claim broadcast rights, but I would assume that those interested in broadcasting this would not be interested in limiting the viewing of it. If such a copyright claim where made for this broadcast, and one were to get sued for it, I can assure you that the EFF as well as this Harvard professor would be chomping at the bit to help you. Also, as the original material was from this particular courtroom, you could almost certainly get any charges moved to this court, where you could easily get this same judge to throw it out.
