First of all, this is entire thing was initiated by the CRIA (Canadian Recording Industry Association). In Canada, the copyright includes the "sole right to reproduce the work [...] in any material form whatever". That means that in Canada, you're technically not even allowed to make a backup. http://www.canlii.org/ca/sta/c-42/whole.html
Now, since this is in fact a law, the CRIA made the argument that everyone who uses p2p in Canada is guilty of copyright infringement. The Canadian government had to either agree or change the law. They agreed in order to prevent the CRIA to request warrants that would allow them to sue individuals. The CRIA is in it's right here.
Originally, the CRIA wanted to sue every single person that uses torrents and p2p, like they are trying to do in the United States. They wanted the right to get your IP and sue you. The CRIA is made up of the exact same people who make up the RIAA. It's just their Canadian franchise and includes Canadian record producers (insignificant compared to Universal, Sony, etc.)
The Canadian government, in all it's greatness, decided to shut down all Canadian torrents and p2p, with legal action INSTEAD of letting the CRIA sue the people who download intellectual property. It's a compromise meant to protect citizens from legal action.
Quebectorrent can't possibly win. They represent a mechanism of law infrigement. They can't make the argument that they have the right to do what they do because the law clearly states that they don't. And if Quebectorrent were to win and demonstrate that they are not the ones guilty of the crime, then the blame would fall on their users, and they would HAVE to release usage records, by Canadian law. Failure to do so would mean jail time for the owners. And if they made revenue from publicity on the torrent's website (I don't know if they did or not) the crown could even make the argument that they represent a criminal organization. - Andareed, on 11/26/2007, -2/+10Yes, y'all better do something about it.

On the internet, Canadian court ruled that uploading music in broadcast fashion is illegal, but downloading it is legal. However, new legislation is about to change all that:

Administrative, constitutional and criminal law); all Private law is handled using Quebec's Civil Law code. Since this is a lawsuit it will be tried under civil law thus not able to set a precedent for Canada outside of Quebec (Technically it can't set a precedent at all).

- kingcam, on 11/26/2007, -0/+3That new legislation will likely be defeated when challenged in court since we Canadians are already paying a royalty (I think it is like 20%) on all blank media to the media companies because it can be used for copyright infringement. If there is a court challenge it is likely that the Judge will find that we already payed for the files via the royalty.

When CD became popular, I bought many of the same albums again. I think I have paid enough. This coupled with the fact that much of the software I am licensed use at work requires a license manager to practice or learn at home is reason enough to download via torrent sites as long as it's for learning purposes. How much do artists really make off each album that's sold? On top of this, it's the recording industry that often decides how a band will sound. Enough said, torrent sites justify downloading in this capitalistic society.

If i go into a library and decide to borrow a book for 2 weeks, i dont buy the book i read it and then return it. If the record industry would sell their discs 10$ instead of 22 or more maybe we would buy more. If gaming company would sell their games 19.99 instead of 59.99 maybe we would buy more... i am so fed up with people telling me i cant do something... And why would they want to prevent us from downloading an episode of Heroes that we missed, so they can package it and then sell us the package for 89.99??? The recording industry need to realise that not all of us drives Hummers and have limitless pockets.

I'm a QCTorrent user, but I still think Doditz (the administrator) will lose a lot in this fight he takes so personnal.
By the way, they say it's because they have his name, but not to forget that Doditz spoke to a journalist who took QCTorrent as an example in the paper. That's how they thought: "We're not gonna let that happen anymore and getting laughed at us."
