OiNK Investigation: Police Start Making Arrests
torrentfreak.com — TorrentFreak has received information which suggests that British police have made good on their claim that they would go after ex-users of OiNK. Last week, several officers arrested at least one individual for the seeding of a single album. It is believed police are in the process of arresting and questioning others.

Circumstantial evidence would be seeing mp3s on someone's computer then thinking that they must have been obtained illegally and pressing charges. Server logs are hard evidence - it's suspect to tampering, but it's not circumstantial.

I don't advocate the current record industry model that screws over artists, but the artists who want their albums downloaded freely are still a very tiny minority. It's a crime whatever way you look at it. If you don't agree with a law, you protest it and work to change it, but break it whilst its in place and don't be surprised when you get ***** over.

If the copyright holder has a problem with someone sharing their music, it's up to them to get the evidence, and pursue the matter in a civil court. Police should NEVER get involved in these cases. Different if someone is running a CD duplication setup from their garage, as they are making money from black-market sales and generally ripping people off. Seeding a torrent isn't the same thing. At all.

Yes, I understand the RIAA are a huge bunch of crooks themselves, and that they rob the artist blind, but if not for stealing "their" money, you'd be taking it right from the artist.
Not that I never downloaded anything, but at least I know it's wrong, despite any rationalizations I may have made at the time.

To have the legal right to listen to the song (as in own it), you must pay for a license. This is in effect what you are doing when you pay to 'buy' the song. (its the license you are buying, not the song itself).
You are then legally binded by the clauses of the license that you have paid for, and the contract that you have entered.
If that license prohibits you from distributing the song without permission, then you are liable for breach of contract.

Are you going to charge me for providing free internet access to friends and family? Bring it then. Sure you can terminate my account due to this line being used for illegal activity but nowhere in the rules does it say "If you own a wireless network you may not provide the access to others and in doing so are responsible for their usage".
