By trying to do "damage control" on the internet with lawyers, they are merely increasing the quantity of mirrors and drama exponentially, providing endless entertainment for the rest of us.

(tm). - nizzy1115, on 10/10/2007, -2/+22question. they are uploading "fake" content and suing you for downloading the real thing. however, you never downloaded the real thing, you just got their "fake" movie/song etc. technically, while you attempted to steal, you never actually stole anything. it'd be like walking into a warehouse, stealing a box labeled "dvd's" but the box was actually empty. how can you be arrested for stealing dvd's if you never actually did?

They have no way of being sure I had "criminal intent" because unlike the "warehouse" analogy, a bit torrent and torrent sites aren't meant to be searched where as a warehouse is probably meant to be locked...

- yowhat2002, on 10/10/2007, -0/+9Ive had a C&D because of something i downloaded from isohunt(I forget what) but my ISP was really cool about it, they just forwarded me the letter and told me to delete the content(yeah, right) and theyd handle it. Demonoid is where i hang out most of the time now though. I see they didnt make the list.

Did the same (replied saying I had deleted the content) but I've been VERY wary of anything I've downloaded since then, especially on public trackers, but moreso now on private trackers.

If it turns out to be some hot off the press movie, of course I would be appalled and delete it immediately. My only goal is the noble effort to better understand the fake *****.

And who in their right mind visits fulldls.com ... that's such a spyware infested place it's ungodly and should be removed from existence... The first and only time I went to that site to find something, I had over 6 notifications of trackers, trojan alerts, etc from my firewall and other software... stay away...

Of course, well, if you use torrent you are distributing at the same time you are downloading - and maybe that's the rub, but a fake file? I dunno, sounds like shaky legal grounds since no real files changed hands. And - this is not criminal - it's civil. Don't know how 'intent' applies here.

Your comparison should actually read this way: It's like walking into best buy, taking a TV, then magically a new TV appears where the old one one. At no cost to Best Buy. As soon as you leave then bring it back in, you are caught for stealing. It could then be argued, has best buy really lost anything to theft if that is the way it works? I don't think so.
- Naga10, on 10/10/2007, -0/+2Same thing happened to me, actually. It was a first time offence, so my ISP was cool about it, but you have to be careful what you download. Pirate Bay and MIninova seem to be the safest places to go for it at the moment.

- oldhick, on 10/10/2007, -1/+0You guys and your comparisons... First a torrent search site isn't anything like a Best Buy. Many of the torrent search sites return torrents for content that is completely legal to download. For instance, movie trailers, VMware appliances, non-copyrighted movies and audio... Additionally, content is often misnamed. I may not realize that downloading a Transformers torrent was an illegal movie and not a legal trailer being distributed via torrent. I might be looking for the "fake" movie to see if its some crazy message telling me I'm going to jail for being a thief. At a Best Buy its impossible to be confused as to the legality of the content.
