If she had won in court, that's a different story. Courts don't honor out of court settlements as legitimate legal standing. A judge doesn't decide on the conclusion in that case, so other judges don't have any sort of decision to read and go off of. Just because you 'win' out of court doesn't mean you're right. (I don't know if she is right or wrong here.)

Her argument of patent infringement (on one of her two patents in question) hinges on her approved patent that is for: “A method of forming a low resistivity semiconductor from a wide band-gap semiconductor substrate . . . .” That is about as general as you can get. This is the kind of thing we see "patent squatters" do, when they realize that technology is on the brink of a certain function, and they quickly file a patent for the "method" for that technology to operate. However, I don't think that that was her intent when filing the original patent. She was describing, in broad terms, something she actually invented, which is at least one thing that separates her from patent leeches.
My point is the patent leeches usually don't win (digg would ***** flip *****!) *because* of the vagueness of their patents. Again, while I truly do believe she filed in all sincerity, granting her an award for this lawsuit would be a slippery slope. Can you imagine if Henry Ford filed a patent for a "mechanized device to move people"? He could sue any person that produced any other car, airplanes, elevators, those ***** shoes with the wheels on the heels (I want to clothesline every kid that wears those, btw)...
Ideally, I hope these companies settle out of court with her, she gets a good payday, the companies can still produce LED-like devices, and I get to clothesline one of those kids with the ***** wheel-shoes. GAHHHHH! - LanEvo, on 03/22/2008, -21/+43what a bitch. ***** patent trolls.

if this is a new patent then it should not have been approved due to prier art...
I think that there should be a change in law so that a patent should be enforced or you loose the right to press the issue after a few years.
If she did invent the LED then she is in the field of interest of electronics and should know that the LED has been use by many company's for many years, she had a case 10 years ago, she knew about the products and dident take action.
if I have a patent and I see product in the market that is in breach of my patent should I be aloud to sit back and wait till the market has sold a few billion dollars of product and then come in and ask for a cut of the $$??
