FROM THE ARTICLE. H.264 is technically still patented. They ruled in favor of Broadcom because the jury found the patents *uninforceable* not *invalid*. Two distinct differences.

It is written in a language and as such it is the same as literature or music. You cannot patent a new form of music such as Jazz in the beginning of the 20th century. Or how about patenting literature in the form of Science Fiction. or patenting a literary device such as the rhetorical question. Copyright yes but patent... hell no it's ridiculous that this is even an issue.

H264 is STILL patented. Note that the ruling is Broadcom vs Qualcomm, not Broadcom vs MPEG LA which is the standard body. Only Qualcomm's claims for patents were dismissed, not everyone else's.
For all intensive purposes H264 is just as patented as before, this ruling simply prevented it from become MORE patented.

- mrpippy, on 10/12/2007, -2/+1If you dig back through the business pages on signonsandiego, you might see that Qualcomm isn't patenting software per se--the patent apparently covers integer transforms, which are used by H.264 for compression. The main question that I had while reading coverage of the trial was: if Qualcomm held this patent, why didn't they bring it up during the standardization process? Standards aren't made overnight for exactly this reason.
