For now, they have nothing to lose and it costs them nothing to spam. The battle is currently won by spammers. The cost to businesses is enormous. Postmaster who have legitimate newsletters or periodicals who are sent to subscribers can never know anymore whether they will reach their readers or not and many times are blacklisted erroneously. False positives, especially at Yahoo, are about 30%. The spammers are laughing all the way to the bank.

If its a legitimate email, it will get through after 2 or 3 trys and be added to a whitelist database, if the mail is sent by a zombie, it will never retry and never get through. Eliminated 95% of spam for me.
