Rulings should not be based on how much money you have personally, they should be based on the case at hand only. If he gets $500,000, then everyone filing a similar suit should get that same amount. This law, while it can prevent unnecessary lawsuits just to get rich, ignores how hard it is to get a good defense without money. Slander on a rich person= noone really cares, they usually expect whatever, but on a poor person, typically you can be alienated to a large degree. People will lose jobs, friends, family may turn on you etc etc.
Or maybe I just watch too many cop shows on TV.

Our jurists have opted OUT the industry of civil damages you have stabilished in the US. In the US it's easy for someone to smoke a cigar, get cancer and then sue the company of millions of dollars. I know I'm over simplifying it, but you get the point. Here in Brazil, the jurisprudence understands that civil liability shouldn't make the person rich, it should only make up for the damages, or, in other words, return them to the "status quo".
And yes, this may come to a shock, but anyone that studies the law here knows that when it comes down to "moral damages" the exact same fact is ruled differently depending of the social conditions of the parts involved. You're kidding me, right? The goal of equality is to IGNORE a person's status, fame, race, riches, etc. and base decisions on the issue at hand. Once you take any of those things into account directly, you have ignored equality altogether. If that is the definition of equality you're running with over there I can see how this ass-backwards system would be put in place.
The definition you just gave is exactly the kind of definition I would expect from a King or Lord in the Dark Ages. Everyone is equal, it's just that some people are more equal than others. LOL
Your example is flawed because you are comparing a case which those millions of dollars would never go to just one defendant, which is why you can sue for millions. No one could sue Google for $500,000 in damages for a few fake profiles, famous or not. You get the amount of money that is fair given the case at hand, not who you are. - fraul, on 11/11/2009, -10/+10You guys shouldn't be defending Google without knowing all the details. Rubens had requested many times trough all the channels available that the fake and ofensive profiles were removed, but Google didn't do anything. The judge didn't rule that Google is responsable for everything that Orkut contains, but from the moment they are formally requested to take down fake and ofending pages (wich Rubens proved) and they don't do anything they become liable.
For the record, decisions like these have been ruled many times here in Brazil. The only difference in this case is that our jurisprudence understands that when deciding the value of the indenization, the judge needs to consider the economic condition of both parties. Since Rubens is rich, he got a lot of money. If he was poor, he would win anyways, but a lot less, since 500k to a poor person would make him "rich without justifiable cause".
