It's also completely possible she could have missed the phone on the counter. I know I don't do a sweep of my bathroom for recording devices before I get in the shower. Depending on the setup of the bathroom she could have came in, undressed and turned on the shower she could have been facing the wrong direction the whole time and her only chance of seeing it was when getting out. 1. I might be wrong and please correct me if I am but don't most camera phones only tape like 1 minute of consecutive video. How would he be able to set it up and then have time to get out before she gets into the shower.
2. While he was still in the house she goes in to take a shower, discovers the phone, calls her sister, takes the memory card to the store, waits an hour for someone to assist her and convince them that she needs to view a video on another phone alone, is shocked, and finally returns home where the geek is still picking his nose and defragging her hard drive while being stalled until the police show up.
While I hate the Geek Squad as much as anyone else, I personally think that this girl went into the bathroom and found that the technician had accidentally left his phone on the sink(not taping or anything else). She figured she could use this to her advantage and came up with the plan. Well that is my theory. - geoken, on 10/12/2007, -1/+35I don't understand what's so implausible about her story. This seems like a pretty likely chain of events;
1) Mom and daughters chilling out after geek squad guy gets there.
2) Daughter tells mom she's taking a shower, geek squad guy over-hears.
3) Couple seconds later, while daughter is getting her stuff together, geek squad guy asks to use the washroom. The rest is self explanitory.
And for anyone questioning #2, it's pretty common in many households (including mine) to tell people you're going to take a shower in case someone needs to use the washroom or so nobody starts the washing machine. Even if 2 didn't happen, it's isn't a stretch to think that the guy would put the camera there hoping something would happen considering how long he was at the residence for. - doolittle, on 10/12/2007, -2/+35I doubt the courts will find this individual's actions were performed on behalf of the respective employer. It may be he has had a prior conviction for similar acts, she can prove they knew about it and gave him the remote tech position with complete disregard then maybe she will have a chance. If he did have a prior conviction I have a feeling that would already be released by the media so it is probably his first conviction so not much she can do about that.
Good luck to her, the reality is the employer will be found not guilty and not responsible - the good thing is this person will have a jail term and a conviction record, so even if she looses the lawsuit she wins with that respect and IMO that is more important than some media-grabbing lawsuit headline. - inactive, on 10/12/2007, -4/+37From the video, it sounds like at least her sister and mother were also at the house. - stryker2you, on 10/12/2007, -0/+28I had a similar situation happen a while ago...this young (25-30) single women had accidentally deleted some "family" pictures from her laptop...well i offered to recover the data for her so she didn't have to pay between $200 and $1500 for a data recovery service...within about an hour i had recovered every deleted file (no not from the recycle bin, it was empty) and quickly scanned them to make sure they were of her and her family...well, lets just say they were her alright, i stopped looking at them, told her i found a bunch of pictures that looked like they were hers and told her i didn't go though them all, but that she needed to. I felt by saying that, it might help her to be less embarrassed. It worked, since i helped her with her computer a few times after that.
