- smaragd, on 10/10/2007, -19/+76ZOMG! Thomas Hawk dares to point out how asinine, constrictive and inconsistent Flickr/Yahoo's TOS is! He must be the antichrist! /sarcasm

http://www.flickr.com/photos/11882655@N02/11968243 ... - fname, on 10/10/2007, -0/+41Flickr has now apologized, http://www.flickr.com/help/forum/54689/page2/#repl ...
Maarten, We messed up and I'm very sorry that your photo, "The Romanian Way" was removed from your photostream. It should not have been and I'm working with the team to ensure that we have a better understanding of our policies so that they are applied correctly.
Maybe flickr staff should consider giving people a chance to download their photo's before they remove them, after all there is a good chance people don't have all their photo's on their hard drive...
One of the next items on the job board is a sort of holding pen for photos so that in issues like copyright and such as what happened to Maarten, the photo could be put back with the associated meta data in place. - gn0stik, on 10/10/2007, -1/+34And technically he's a cherub. Not a child. He could be thousands of years old.
/sarcasm - Bloc, on 10/10/2007, -2/+31Smoking is legal at 16 in the UK. It's probably lower in other countries.
- Frost9999, on 10/10/2007, -6/+30If this guy is serious about his art - then he can make his own ***** website. It's 2007, all the cool kids are.
- dbarefoot, on 10/10/2007, -5/+26Really? 18? How many millions of photos does Flickr host of teenagers smoking? They've got their work cut out for them.
What about these wankers? They don't look 18: http://www.flickr.com/photos/sorter/5961193/. - muffins, on 10/10/2007, -0/+17Dammit people you have to open a sarcasm tag before you close it.
- inactive, on 10/10/2007, -0/+16Yes, what an excellent analogy, since sex is so unhealthy and bad like smoking.
- superkendall, on 10/10/2007, -2/+17So how poor are kids really if they can afford cigarettes?
- daftman, on 10/10/2007, -13/+26Yay, Flickr/Yahoo are now the moral police.
They might as well censored Michelangelo and other great artists as their artworks often contain nude male/female/children. - gn0stik, on 10/10/2007, -1/+14awesome, it's cool that they apologize and don't just stonewall as most corporate entities do now days.
- xruntime, on 10/10/2007, -6/+18Meh, Flickr is filled with near-porn, and they go after smoking >.>
Does Picasa do this as well? - gn0stik, on 10/10/2007, -6/+18 Most smokers try not to offend others. But some are just always offended. Where's the immorality? Smoking is not a moral.
- inactive, on 10/10/2007, -1/+12It's an American company, so they tend to go by American laws and standards, just as a similar one in the UK or Iran would conform to their cultures.
- fname, on 10/10/2007, -6/+16Actually, Flickr alternately claims that it's not in their terms of service. And Flickr staff says it has nothing to do with Yahoo! Mostly, Flickr users would just like to know what the policy is.
- UtopiaInTheSky, on 10/10/2007, -4/+14The kid isn't *actually* smoking, though.
- gn0stik, on 10/10/2007, -10/+19So, because "underage" is 18 in america, it's against their TOS? OOOOooh that's right, the internet starts and stops in AMERICA.. I forgot.
/sarcasm - ZXDrew, on 10/10/2007, -5/+13why do people have to write "/sarcasm"... I think we can figure it out
- rockmanac, on 10/10/2007, -1/+9"Maybe flickr staff should consider giving people a chance to download their photo's before they remove them, after all there is a good chance people don't have all their photo's on their hard drive"
Um.. Seriously? You don't keep a copy?
-A - 22magnum, on 10/10/2007, -1/+9The picture isn't promoting underaged smoking. Its doing the opposite and bringing the problem it into focus.
- Diggaholics, on 10/10/2007, -2/+10No, it would be best if they made the decision to not smoke at all.
- kedohmen, on 10/10/2007, -3/+11I call BS. I've had a picture of a 5 year old Asian kid smoking on my flickr page for years.
- tavisjohn, on 10/10/2007, -9/+17If you do not like their TOS, then go somewhere else.
If you can't find an image hosting service that will let you post smoking kids, then either check out Pirate Bay's Image hosting service, or GET YOUR OWN DAMN HOSTING SERVICE AND SET UP YOUR ONLINE PORTFOLIO THERE!!! - quomen, on 10/10/2007, -2/+9If you're not happy with the service, take it somewhere else. You teach them by putting your dollars somewhere else. Television shows only care about content that they think you will watch.. if you dont like it, watch another station. That's how you fight the companies. I've been happily using smugmug for quite a while already.
- chrisnixon, on 10/10/2007, -10/+17I think the point is that whether or not it is in their TOS, Flickr and Yahoo are becoming increasingly restrictive as to what THEY see as acceptable. It is done without any consultation with their users. While underage smoking is illegal, it is not immoral. Television news regularly shows illegal activities because it's reportage. Why are Flickr users/customers not shown the same respect. It's illegal to smoke in a bar in many parts of the world. Should Flickr be censoring that too?
- dewyjuhl, on 10/10/2007, -0/+7is this really that appalling?
- Diggaholics, on 10/10/2007, -3/+10Because you can not tell tone of voice over the internet and a lot of people take what people type at face value...
- nreynolds, on 10/10/2007, -1/+8link please.
- aaronm67, on 10/10/2007, -1/+7Depends on where you live, as smoking laws are very different from state to state, but for the most part you're wrong.
- wiihuck, on 10/10/2007, -0/+6making your digital picture black and white is not art.
- accelleron, on 10/10/2007, -2/+8A quick images.yahoo.com search showed that they aren't very adamant about that policy.
- paulbyrnes, on 10/10/2007, -2/+7And what a pair of tossers they are. Good one mate!
- Diggaholics, on 10/10/2007, -3/+8You're telling me she's 18 in a kiddie pool with a fellow little girl??
http://www.flickr.com/photos/visitronix/1354117118 ... - Diggaholics, on 10/10/2007, -2/+7Stealing is pretty cheap actually..
- juicebag, on 10/10/2007, -0/+5I agree. Sex gives you cancer and kills you. But inhaling smoke, tar, and various other chemicals is natural.
- tnoy, on 10/10/2007, -1/+6You're being sarcastic there, right?
- DrLaunch, on 10/10/2007, -1/+5I've actually seen several porn albums on Picasa Web Albums. And I don't think their TOS says anything about porn.
- zeptobyte, on 10/10/2007, -2/+6Such as Flickr. This isn't IN the ToS, which is the issue.
- drew30319, on 10/10/2007, -3/+6Thank you Tavisjohn and Tsol4u for being voices of reason. A shame that the majority feel a sense of entitlement.
(insert obligatory anti-Bush, anti-US, anti-whatever rhetoric) - jonr, on 10/10/2007, -0/+3So I guess crack smoking kid is ok, but tobacco not?
http://www.flickr.com/photos/beija-flor/3724653/ - lovetek, on 10/10/2007, -0/+3As of 1st October the age is going up to 18.
- KibibyteBrain, on 10/10/2007, -2/+5That almost works, but the problem with Web 2.0 and that is that community is a key element of any Web 2.0 type service. Certainly if you are just a person who uses Flicker to casually post photos and send links to family members once in a blue moon, that thinking works perfectly. But for hundreds of thousands of users who have build relationships that only really exist through that service, its a bit harder to tell them to somehow migrate that social net somewhere else. Its just like digg. There are a billion clones of it, yet digg really has nothing to fear, even from users who are unhappy with some of its policies, because they can't just leave and expect the same social aspects to the service elsewhere...just the service itself is not enough.
This is why I think some sense of democratic control of policies will become an important development in the maturity of web 2.0. - Intangible360, on 10/10/2007, -2/+5Are you serious?
- MaxPayne3476, on 10/10/2007, -1/+3...see once again, its HOSTED in the United States... and we do have "foreign" kids here
- fname, on 10/10/2007, -0/+2Nope, I submitted it on my own. In fact, I pulled Thomas Hawk into it when I asked him to blog about the story yesterday. Today, I left him out of it because he seems to be a lightning rod.
- Tsol4u, on 10/10/2007, -4/+6I dont understand what the problem is Its their server and their terms. If its against their TOS. if you dont like it make your own server for pictures
- ryodoan, on 10/10/2007, -1/+3Are you saying he is making it up? That is a shocker... seeing as if you actually had read any of the related comments you would see Heather had personally responded to him on the issue.
I am not a regular flickr user but apparently Heather is some big important person there. -
