Facebook awarded $873 million in suit against spammer

venturebeat.com — On Facebook, the spam you get from friends is bad enough, but tolerable. The really bad stuff is actual spam, which more and more people are being subject to. On Friday, judge Jeremy Fogel in San Jose, California, awarded Facebook $873 million in damages against Adam Guerbuez and Atlantis Blue Capital under the CAN-SPAM act.

  • LawMan227, on 11/25/2008, -0/+4I'll give you a crash course here... judgments in America are good for 20 years, you can make a motion to renew a judgment for another 20 years. Hence the $873 million follows this guy for the next 40 years, plus interest. That means any bank accounts, assets, or wages can seized or garnished over the next 40 years. Here is the rub... this guy lives in Canada. If he is smart, he is doing everything he can to transfer any assets he has in America to Canada, if there are any. If everything is already in Canada, Facebook just won $873 million in nothing... An interesting side note, if this guy does not answer a request for information regarding the personal assets and holdings, Facebook can move to find them in contempt of court, and then move for an arrest warrant. So if this guy ever came to America, he could be arrested... 2 notes on that, arrest warrants expire, and he would be released once he disclosed all his assets... which would probably be in Canada and unreachable anyway.
