I would classify that as hacking. Perhaps not the most elaborate movie style, but I would say it is indeed hacking.

This was a setup from the get go. Anyone else think it's strange that an organization like TorrentSpy.com would have low security admin passwords?
He isn't getting sued, but not MPAA can't do jack to TorrentSpy.com because the data was obtained illegally and the case was brought to court. Once this gets dropped MPAA can't touch them, brilliant in my opinion.
