Engadget painting the town magenta
engadget.com — After yesterday's very real and not-at-all-fake story about Deutsche Telekom demanding Engadget discontinue using the color magenta, and today being what it is, we're putting up some new wallpaper on all the Engadget sites and ever so slightly tweaking Engadget Mobile's logo. We hope you approve!

I think we've learned from stuff on Digg in the past that if you have a trademark you more or less have to enforce it, and instead of realizing this I guess Engadget decided to just blatantly violate their trademark.

I'll say that at least T-Mobile has tried to be civil, there is a snowball's chance in hell that someone would mistake the Engadget mobile site for T-mobile.
- mecki78, on 04/01/2008, -1/+3What you say is absolutely correct. You need to defend a trademark. And the letter was not only polite, it was ultra polite. They haven't threaten them, they stayed all kind and helpful. So I think the way the letter was written and the way the company acted is very, very positive. The main problem here is: No company in the world should own any color. "But...", no but! No argument. A color can't belong to anyone. Think about it: If companies own colors, after about 32 companies all the normal colors are taken. So how would you make your webpage then? You need to make it black and white. So nothing wrong about the company, but shoot the person who allowed them to have a color as trademark.

So, for example, UPS owns that particular color brown within the shipping industry. FedEx can't use that brown if they decide to change colors, as it would violate UPS' trademark. Coke owns the color of red that it uses on it's soda. No other soda company gets that same shade of red. There are a ton of trademarks like this. The same thing applies here. That color of magenta is a trademark of Deutche Telekom and it's subsidiaries, which include T-Mobile. So no other cell phone company or mobile service provider can use that color of Magenta. That being said, it's certainly true that engadget is not a mobile service provider...but Engadget Mobile is certainly sitting on the boundary of what could be considered a violation of that trademark, because they specifically make money (through ads or otherwise) promoting mobile devices and services through their website. And while it may not be confusing to you or I what engadget mobile does vs what T-mobile does...there are plenty of people out there dumber than a rock who can't tell their left foot from their right, and this could certainly potentially confuse them.
These trademarks don't just apply to colors, either. If one recalls the lawsuit brought up by Apple Records not so long ago, against Apple Computer...they'll realize that the suit only came about once Apple Computer stepped into the music business with it's ITunes software and iPod hardware. before that, there was no overstepping of boundaries between the companies, and nothing 'confusing' about the trademark of either company. And, as stated above me, a company has to defend its trademark, or it will get revoked. I believe this happened to Xerox and Kleenex a long time back, because the brand names became so synonymous with the products they produced that people would use their name instead of 'photocopy' or 'tissue'. Ecco explained it incredibly well, but basically you CAN trademark colors, and it is justified because many companies have a color specifically tied to their branding. It is important to state that you can't just trademark "blue," it'd have to be a specific shade of blue; T-Mobile's magenta is RAL 4010, not just magenta.
