Sadly, the DMCA is reality. You have to comply with it just as much as Google has to. I don't see "taking forever to put it back up" as proof that the Chinese Government is somehow influencing Google

She writes, "While NFL merely had to affirm that it was or was authorized to act on behalf of a rights-holder to take-down..." but that's not true. The DMCA requires more than an affirmation that one is authorized to act on behalf of a rights-holder. It also requires a statement that your content is being infringed, and that you have a good faith belief that the usage is not authorized by law. That's much more than she said. Then she complains that she has to swear to "much more" than the other side, that she had a "good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled." Well, that's not much more, it is simply the logical negation of what the other side (the NFL in this case) had asserted in the first place. She is saying that they were wrong to claim that it was their content or that the use was unauthorized. That's misidentification or mistake.
Two key points to take away are, first, that there is a perfectly reasonable counter-notification process defined in the DMCA, so that anyone who get a genuinely unfair DMCA takedown notice can reply, and the content MUST be put back up. Second, 99% of the time, people don't do this because they know full well that the content was infringing, and they don't want to swear to a falsehood under penalty of perjury. - jimmarch1, on 10/12/2007, -0/+2Counter-notifications ARE possible under the DMCA. Google provides the Chinese Government technology to suppress their people on a much larger scale then they could do on their own. The Chinese Government teaches Google how to suppress information by removing it instantly then taking forever to put it back up. Google has become EVIL!
