You cannot expect digg.com as a company to not respond in some way to a cease and desist notice form a company that is sue happy. But it is wrong for Digg to take down stories in any situation and still call itself democratic. Take a step back and look at the situation. We have shown the digg crew what we would rather them do, and they appear to be moving in that direction “But now, after seeing hundreds of stories and reading thousands of comments, you’ve made it clear. You’d rather see Digg go down fighting than bow down to a bigger company. We hear you, and effective immediately we won’t delete stories or comments containing the code and will deal with whatever the consequences might be. It is time to take a step back and let the group handle it, before we destroy a site that we all love (at least love enough to create an uproar so large as this one has been). But Since we all fell like attacking something let us attack the DMCA and end this kind of crap at the source rather then attack a third party required by law to oblige.

I mean, Digg is essentially dead as of right now as it is flooded with literally hundreds of posts about the key. And now that they have basically lost control of the situation, they say, "Oh, we're sorry! We'll fight for you!" Did you -really- have a choice at this point?
Something had to give.
I'm more inclined to think that everyone sat around a conference table and said, "We can't keep up with this. We either let them do what they want, or take the site down," not, "We messed up here. We should have gone to bat for our users like Google did, or like Slashdot has done - even if eventually they still had to take down the materiel, they built strong loyalty from their users by standing up for them."
But more seriously, they've screwed themselves in the eyes of the law. If they had never removed comments in the first place, they'd have a legal leg to stand on, but because they've shown that they can and do have editor powers, they are not protected at all. If you delete one, you have to delete them all (as far as I understand the DMCA). So it's really a matter to too little, too late. You might as well continue to delete the posts now or you're going to get pounded. And no, you can't blame the users if you do get pounded. Kevin's post on the blog isn't some honorable stand for what's right; it's self-preservation. At first, the "safest" course of action was to heed the notice from the HD-DVD people, but as the ***** kept getting more and more powerful it became more and more obvious that the respect and adoration that make Kevin and Revision3's projects so successful was fast disappearing, revealing a new priority: maintaining the "internet rockstar" status that Kevin's career is built on. The seesaw tipped on its own; Kevin is just sliding from one end to the other.
If he'd taken this stance from the beginning, as his reputation practically demanded, there would have been no ***** like this - in fact, quite the opposite. He could have remained silent on it and let it pass, or made a post about standing up to the ridiculous takedown notice to earn some admiration. But the fact that he let it go on for so long points to the insincerity of making this move now, in a last-ditch effort to maintain his status as the posterboy of most things that are going right with the web these days. Trying to get back on the side of the users is almost like sneaking from one side of a battle to the other when you realize you picked the losers to start with, and it's a cheap play to save face.
Will it work? Probably, as already evidenced by all the WE FORGIVE DIGG and DIGG THIS IF YOU LOVE KEVIN ROSE comments above. Does he deserve your praise now? ***** no - it's a blatant attempt not to be left behind in an angry cloud of dust.
tl;dr version: Kevin's blog post is insincere and came too late after a line had been crossed. His newfound support for the "Digg resistance" is based on nothing other than a desire to save his reputation and his relevance, and is blatant and disgusting. He'll gloss over it in his next podcast and try to portray himself as some kind of rallying point against overbearing DMCA/copyright law, and most Diggers will fall for it, even though they shouldn't. He doesn't deserve your respect for this at this point; the choice was easy to make by the time he made it. - TriteLife, on 10/12/2007, -39/+193The only problem with dying fighting is that Digg is doing both. Whereas the community just reads about it and moves on. The only thing they lose is a site off their bookmarks. - DigiDave, on 11/13/2007, -13/+145I'm still left with a big question mark on my head: Digg got a cease and desist letter but according to first ammendment law (of which I might be a little rusty on): news organizations have the right to re-print material that private companies don't. I don't think it's a stretch to call Digg a news organizations (of sorts) -- and I think they know that.
The real problem here is that Digg, which is supposed to be a "democracy" and all about freedom of speech -- banned USERS (not just stories) for mentioning something that was on every other major tech news site. I bet a lot of those sites didn't pull down the information at the first sign of a c&d order: Digg pulled it down because the letter was coming from a PAYING SPONSOR.
It was only after being called out that Digg has decided to sack up. "At least we went down fighting." -- I doubt this will end up in a lawsuit -- I don't think a real lawsuit was ever an issue: Although the individual user who re-published the info might be in trouble -- digg the organization would be in the clear -- and their lawyers would know that. A small minority has lead a mob mentality, wreaking havoc for the majority and ruining the experience of all users.

He can keep nuking stories and banning users, or he can face a possible lawsuit - and do note that digg sells nothing, and has no income apart from ad revenue - it might be "worth millions" to a potential buyer, but that won't pay the lawyers. The 'let's post a magic number protest story' thing has clearly caught on, and probably quite a lot of people would be driven away from this site were the bannings to continue - and less readers means less ad revenue means less potential value digg has!
