On the topic of banning, I don't imagine that it'd be too difficult for Digg to smoke these guys out:
1. Set up a lame page about something which no one should conceivably be interested in digging by themselves.
2. Pay uSocial to get it on the front page.
3. Ban the initial flood of users that get the page to popular status. (These users are obviously on the uSocial take)
4. Rinse and repeat.

But now that Digg have unambiguously stated their intention and the reason for it, they have cleared themselves for tweaking their filters, and if necessary banning some Digg users to block the gaming of their system. So now they can deliberately kill the viability of USocial without any legal worries. That's how it's done.
