The uri below (to the .kml file provided by Maxim) is simply an overlayed image (provided by Maxim) _on top_ of the actual Google Earth images. This image does not appear on anyone's Google Earth without clicking and downloading the .kml file (which holds both the image to overlay and coordinates at which to place it). For proof, download the .kml and deselect the Maxim Cover in your Temporary Places.
Remember.. Google Earth/Maps images are usually between 1-3 years old. Its not like Google Maps or Google Earth is realtime or close to acurate, most images are around 5 years old

google does not own the imaging satellites, they just buy the images from the companies that do(mostly NASA) and place them in their program. So it wouldn't cost much to have one of the companies to take a picture for you and then just send the images to google.

The MSN reporter may well have thought they confirmed it by opening the google earth .kml file. If they did that edited the placemark they'd have seen this...

Google does not CONSTANTLY update its satellite images. Most images on there are YEARS old. (Especially in non-major cities.)
