The RIAA uses their strong-arm tactics to target people without the cash to handle the legal system. They hope and PRAY you don't fight. If you do, THEY LOSE. They have been skirting and flirting with criminal activity themselves with each lawsuit and extortion letter. Once a few precedents pile up, they will be forced to regroup and make sure the people they sue are even poorer... so they can get them to , out of ignorance, admit "guilt" and be branded...
This is nothing more than a legalized mafia. The RIAA is a cartel. If you don't cross them and be a good music mule, they won't come break your knees. One or two of these won't kill them, but it'll sting a bunch. If they get too many of these... perhaps they could become as effective as the UN in affairs. :P
My advice to the *AA's:
Get used to it. Sooner or later you're going to poke the bear too much. The "ooh shiny!" distraction tactics used to keep the sheeple in line are finally breaking down, since it's becoming more and more mainstream what the RIAA is actually doing. And their drek is falling on deaf ears.... independents and classics are replacing the 40 metric tons of also-rans that the RIAA has been shoveling since day 1.
People may not be organized as a group to rise up and slay the evil giant, but rootkits, DRM fiascoes, lawsuits, and every 15 seconds telling the customer he's a thief for burning a copy of his music for the car or a mix CD is coming back to haunt them. Individuals and groups, independently of one another, are simply not spending anymore... and more are doing so. Let's hope the trend continues. It's probably somewhat related to high gas prices and other pressures, but still... it is funny to watch. The "vital" industry that makes a luxury item is realizing that they are not essential to day-to-day living for the average American.
But, we're just one "shiny thing" away from it all becoming moot again. Leaving us geeks to hold the pitchforks and torches by ourselves. Let's hope it's not for a while... ;) - Phyltre, on 10/12/2007, -2/+15More than your wallet comes under fire in a courtroom.

Ms.Foster is the "prevailing party" (legal talk for.. "she beat you at your own game") which means the RIAA is liable for fees and costs incurred by Ms. Foster in her pursuit to clear her name. The Court indicated that it would decide the attorneys fees award question upon receipt of a motion for attorneys fees. You can find the gory details of the ruling here.

I don't think you can legitimately say that the sheep are becoming the wolves or throwing off their shackles and slaying giants, etc... As near as I can tell, most people just conform to the stereotypes that they perceive as normal / cool. And people will always, always, do what they want. Even educated nerds such as us are susceptible to this, which is kind of a bummer, eh? People haven't changed, just the things that are becoming popular culture and the cool thing to do are changing.
