First off, if the video is 29 seconds long, doesnt that fall into the unspoken 30 seconds fair use policy? If this goes to trial and loses, this could be precedence to tighten up copywrite laws even more.

He recently distributed hundreds of thousands of albums free with newspapers, causing his distributor to withdraw an album from sale.

You film someone, there is music in the background, you're suppose to license the music, you film someone in front of a building, you may have to seek the architects permission as it may be copyrighted... You're not filming the building itself, it just happens to be in the background... and it's like that for everything...

All of it is released under Creative Commons and they don't ***** with the normalisation like the major labels do. Even better, I can talk directly to the artists on their own forums, download the samples they used and mix my own music (badly).

I can't see how this is a "frivolous" lawsuit, when you consider the hundreds of lawsuits targeted at so-called "pirates" and "theives."
