What would be nice if you went and hired your own suit to tell you what the law is, rather than listen to the shills from the mafiaa. Because there is no "intellectual property" to a sequence of numbers in the public domain. It's not a DMCA circumvention device either.
Instead it would have been better if you would just be honest and say "look, we really don't want to hassle with the lawyers right now, so we have to pull the stories for the time being." Rather than cough up the lametastic "respecting intellectual property rights."
Because the truth is, there is nothing to respect here. Look at the front page of Digg and you wouldn't know anything was happening. Compare that to the Digg BigSpy and you'll see that a large percentage of active stories concern this matter. Everything is being removed even stories that are discussing the implications of Digg's censorship.
There's also the fact that Diggnation has taken sponsorship money from HD-DVD which story has also been disappeared. You'll find people would be understanding about specific takedowns if the URLs remained in tact the votes remained in tact and the article contained a notice that the content had been edited. Just as Google does to comply with local laws.
My account has been disabled for doing what nearly everyone on this site has been doing, talking about the biggest news story of the day. Almost every week we receive cease and desist letters from attorneys. With 6-7,000 new stories being submitted every day, we are bound to link to illegal content from time to time. So we get these notices. It happens.
Today we were notified about a story that linked to intellectual property that is protected under the DMCA. We contacted our attorneys, and they gave us their advice: remove the stories. If we don't, we can be held liable for damages, and by damages I mean enough to shut us down.
This is difficult. We are a small company with handful of employees, and we don't have the resources to fight a battle. I don't want risk a lawsuit that could end up with digg being shut down, so we removed the stories.
Personally, I'm not a fan of the DMCA and any DRM'ed media (including HD-DVD). I'll talk about this in detail on the diggnation episode airing May 12th. - misterhardcore, on 10/12/2007, -23/+152Damn the man.

The reality here is its far too late to put the genie back in the bottle. Unless the AACS people have a way to deal with the reality that this number is known, then to attack the freedom of speech of large numbers of people for pointless and in itself a cause for concerned action.
digg has many problems with its lack of moral and ethical understanding, with this just being one example. They are far too quick to attack users, ban them and try to impose their concerns on others. Its no good saying they can do what they like because they are not the government - everyone has to be held to moral and ethical standards in how they behave. That includes respect for the basic human rights which include freedom of speech.
digg should unban all those they have attacked in their desire to chase cash. Well, to repost it - you cant copyright a number, its not anyones intelectual property. Digg needs to hire a lawyer who knows what they are talking about, and they will tell him that the "code" falls into trade secret law, and the "rule" in that is that once it is in the public domain, it is no longer illegal to post it / comment on it, etc - the only people who can be sued are the ones who originally posted/leaked it.
