- rhartman, on 07/08/2008, -1/+32FTA: The RIAA has tired of fighting motions to quash in college Doe cases, and last month decided to double the settlement fee for students who challenge the labels' subpoenas. Instead of settling the RIAA's infringement claims for as little as $3,000, students who fight the subpoenas and lose would have to pay $8,000 to settle.
This is blatant extortion. "Give up right away or it will cost you more."
How are the courts still largely turning a blind eye to this? - anonymousleaf, on 07/08/2008, -1/+19Well it's time they should. I dream for a day when the RIAA finds it impossible to discover the identity of a "pirate."
- goudie, on 07/08/2008, -1/+16How can the settlement fee not be considered extortion?
- skinnyskittles, on 07/09/2008, -0/+13put a little passion into it
- SolidBones, on 07/09/2008, -1/+12"The RIAA defends the fee doubling, arguing that it's in students' best interest and that none of the attempts to quash have ultimately proven successful."
This kind of thinking from overzealous enforcers scares me. - Mactrekr, on 07/09/2008, -1/+11RIAA, "Because Billions of Dollars, just isn't enough"
- WalkerTXclocker, on 07/08/2008, -5/+14Obligatory "***** The RIAA" comment.
- Pittance, on 07/09/2008, -1/+9It was always extortion. Either give up thousands or fight it and possibly lose everything.
- Duositex, on 07/09/2008, -1/+8This entire method of prosecution should be illegal. Why should any firm/organization/individual be able to take legal action against unknown firm/organizations/individuals en masse??
Imagine if someone scratched my car in the parking lot of Wal*Mart so I demanded surveillance footage from their cameras and all of their customer records so I could sue the right person. How would that be fair? That presumes everyone is guilty and then works by process of elimination and is the total opposite of how our legal system is supposed to work! - GruntboyX, on 07/09/2008, -1/+7what really doesn't make sense is if the settlement fees increase the more likely people will fight it. I would settle if it was like 20 bucks...but 8,000 dollars and its worth the chance
- f4nt0m4s, on 07/09/2008, -1/+5I wish I went to a University that wasn't the RIAA's bitch. I guess that's what I get for going to a state school. The University I go to is "in full compliance" with the RIAA. Basically, if the RIAA sends a subpoena to my University, the University will give the RIAA the person's name and logs of IP Addresses.
- yodaj007, on 07/09/2008, -0/+4You can fight a subpoena. You don't have to just roll over and take it. By just taking it without so much as a whimper, yes, they are complying with the RIAA.
- Sairynn, on 07/09/2008, -0/+3I cringed at that line as well.
- ashfish, on 07/09/2008, -0/+3So you want us to start throwing red paint on judges and the RIAA? I might be able to swing that one.
- yodaj007, on 07/09/2008, -0/+3@easypie: Who cares what you put up on digg *****?
Come on. Why do you have to be an ass in every comment thread I go into? If you can't play nice, maybe you shouldn't play at all. - zinc6471, on 07/09/2008, -0/+3but nearly all parking lots i been too have that sign stating its not their fault for what happened on the said premise
but either way... its still gay how they can just run around like this do what they want...oh wait that's the American way.....
: / - layzice, on 07/09/2008, -0/+3So... time to start killing people yet?
- fotbr, on 07/09/2008, -0/+3They're not looking to sue the store...just subpoena the store for all their security footage so they could track down the random soccer-mom who couldn't keep her spawn from banging the door into someone else's car, and sue her for her crotch-dropping's actions.
- KaJuN4, on 07/09/2008, -1/+4And I wasn't invited? What the crap??
- VitriolAndAngst, on 07/09/2008, -0/+2It teaches people not to bet against the house.
Wave your rights and spend a little money -- fight for your rights and spend a lot.
Just lucky they didn't go 10 to 1 odds rather than Double-or-Nothing. - yodaj007, on 07/09/2008, -1/+3First off, I care, and so does rhartman. If you don't care, don't be an ass about it. And if I want my voice heard, I can hold a *conversation*. We're not talking to the courts on Digg! Whatever made you think we were?
And by the way, you don't put an article in front of a proper noun. Everything in your comment is fail. - PopcornDave, on 07/09/2008, -0/+2Well the Mafia doesn't like the competition I'd wager.
- PopcornDave, on 07/09/2008, -0/+2How about the rule of law? The last time I checked extortion was illegal.
Until the RIAA actually proves that the person subpoenad is the person downloading the material in question, offering to drop the lawsuit if they pay the RIAA money is extortion. Nothing less.
It used to be that you were innocent until proven guilty in this country but I'm really beginning to wonder if anybody remembers that anymore. - yodaj007, on 07/09/2008, -0/+2OH GOD MY EYES
TMI! TMI! TMI!!! - caseycoold, on 07/09/2008, -0/+2The's compliance with the law, not the RIAA.
My school (RIT) started to fight it, but backed out after others lost. All it would take it one good win. - VitriolAndAngst, on 07/09/2008, -0/+1Our courts are stuffed with "Federalist Society" members. About 80% now -- a bunch of fascists. That should explain it.
- enigmaneo, on 07/09/2008, -0/+1Why does everyone hate the RIAA so much. They just want to be rich and powerful like everyone else. Is it that everyone is jealous of them?
- VitriolAndAngst, on 07/09/2008, -0/+1"in students' best interest"
>> The real scary thing, is that their are some brain-washed bloggers out there who would read that statement and nod their head. - theaceoffire, on 07/09/2008, -1/+2***** the Passion and ***** the RIAA.
Your welcome. - levelred, on 07/09/2008, -2/+3one tactic that shouldn't be used for everyone. is to threaten to final bankruptcy, most lawyers will bend to make a reasonable settlement after that.
- pyrates, on 07/09/2008, -0/+1So the RIAA raises the settlement if you attempt to fight it? That is extortion plain and simple. I hope they get hanged for that.
- MrObjectional, on 07/09/2008, -0/+1There's actually eight State students moving to quash. The Technician (NCSU newspaper) publishes all kinds of stuff about the RIAA-
http://media.www.technicianonline.com/media/storag ...
http://media.www.technicianonline.com/media/storag ...
"The fact that eight students joined the motion to quash was a feat Stephenson labeled as "quite remarkable and should be a source of Wolfpack pride.""
GO PACK! - forcedfx, on 07/09/2008, -1/+1Chips Ahoy!
- zinc6471, on 07/09/2008, -1/+1yo ho ho
do what you want
cuz a pirate is free
you are a pirate - wedges, on 07/09/2008, -5/+2well would you rather lose 3,000 or 8,000? and, rhartman, since when is 8,000 "double" 3,000?
- inactive, on 07/09/2008, -5/+0This captcha system is annoying..
- leerayIG88, on 07/09/2008, -10/+5I like p2p. I get lots of porn. Everyday there's a party in my pants.
- inactive, on 07/09/2008, -5/+0I would rather lose 8000.
- inactive, on 07/09/2008, -6/+0Pirates AHOY!!!
- inactive, on 07/09/2008, -12/+2Who cares whether it is blatant extortion or not? And even if it is.. who cares what you put up on Digg? If you have to make your voice heard, go and protest. Hold a demonstration like the PETA does.
- inactive, on 07/09/2008, -13/+0Who cares what you put up on Digg *****?

What is Digg?
