For that reason, copy protection measures in software (as well as TCP/TPM) are very useful to producers of closed platforms because they may be able to eliminate the competition by law in the future, and feature in both Apple and Microsoft's work.

With a torrent, they can look at the tracker site and tell if the content is illegal.
This company is crazy to go after the software that is on the receiving end of the stream. They are in effect trying to force all companies to use their technology by using the DMCA to achieve their goals.
