Then a consumer takes Comcast to court, to which Comcast then cries foul, and has the case thrown out because it claims the FCC is the only thing that can tell them what to do. NOW Comcast sues the FCC on its' decision, saying it doesn't have jurisdiction to say they cant throttle speeds? WTH, Comcast? Cant you get this story straight?

They are trying to strong-arm everyone because they have a monopoly in many places. It is time to end building zoning monopolies. Give tenants a choice! Down with Comcast! I also agree with some other Diggers here! We need Net Neutrality laws to protect us from tiered services. Only the rich will be able to get information! The U.S.A. is not founded on that evil principle. The U.S. is founded on the library system! We invented them. Just as libraries are free, so should the Internet be free!

You're getting dugg down, but you do raise valid points. I think the reason you're getting dugg down though is because people believe they are paying for service at a particular level, and that's not being delivered.
I don't know specifically what Comcast offers, but say they're giving you 10Mb down/5Mb up for $50/month (or whatever). The customer expects that whenever they want to use that, they're going to get that 10Mb/5Mb - as described in their contract with Comcast. Unfortunately the cost of offering a dedicated 10Mb/5Mb connection to customers is far, FAR greater than $50/month - so Comcast does a bit of a gamble and over-subscribes their service: say 20 people sharing a 50Mb/10Mb link. Now as long as everyone doesn't use it at the same time - no worries. But when everyone starts maxing out their connections at the same time (as P2P often does), your speeds slow down, HTTP traffic gets clogged and the 'Internet' for everyone seems to be unbearably slow. So Comcast throttles.
What's the solution, then? Well, Comcast COULD start offering dedicated lines, or a guaranteed SLA - they probably do this already to businesses. The catch is that your 10Mb/5Mb service now becomes a 2.5Mb/512kb service, because that's the max they can guarantee for $50/month. Consumers don't like that. Alternately, Comcast could upgrade and offer 10Mb/5Mb to all their customers - but at $200/month instead. Again, consumers don't like that.
They're really stuck picking the lesser of a bunch of evils. Sure, they should upgrade their network and thanks to a monopoly infrastructure they've been profiteering for years. But the fact remains that right now, they're over-subscribed - and they've either got to put in bandwidth caps, raise prices to upgrade the network or decrease the service offering.
