To use your analogy, it would be as if mall security did not let you take something that was being given away freely and legally.

They will probably pull logs converted into colorful usage charts from before they started the filtering to after showing the overall internet experience provided to the majority of the "honest" users is improved and that is where their service has to go. The RIAA and MPAA will back them and if they get to a purchased judge, Comcast will win.

If everyone is forced to use what amounts to 2-3 times 56k level bandwidth, even with ever increasing subscriber numbers they'd *never* have to spend a cent upgrading their connections! But, the title is misleading -- Comcast hasn't been "hit with" a class action lawsuit. One guy has filed suit and is *attempting to obtain* class action status.
