Have a visit. Click on some stuff, maybe download a few product catalogs. I never realized how fascinating tube and rollform equipment could be! - XStatic, on 10/12/2007, -6/+99http://www.utube.com/
Service Unavailable - kalleanka, on 10/12/2007, -8/+93Rofl... "http://www.utube.com/" ==> "Service Unavailable"
That guy is an idiot, he has 2 million visitors a month and 99% are looking for videos. Now, just add a big "Looking for funny videos" link their and sell the traffic to the other smaller video services.
I'm sure that guy is a 60+ guy having no idea what the value of a visitor is. - DoctaStooge, on 10/12/2007, -11/+92I forgot to add this earlier:
They sell tubes. Maybe these are the tubes Ted Stevens was talking about when he said "The internet is a series of tubes". - Ratatosk, on 10/12/2007, -25/+104pathetic
- david76, on 10/12/2007, -8/+61Uhm. Last I checked trademarks were limited in scope by industry and region. An equipment firm has no grounds to sue a company in a completely different industry for trademark infringement.
- petepete, on 10/12/2007, -4/+53I support UTube in their quest for justice.
The amount of times I've become mixed up between online videos and rollform equipment; Its about time somebody sorted this confusing mess out. - DoctaStooge, on 10/12/2007, -11/+55This reminds me of the World Wildlife Fund getting the WWE (then WWF) to change their name because they thought people would write checks to the wrong group. I mean seriously. If they did this when they first found out about youtube, then I don't see a problem, but you don't wait until now to pull this.
- jasper976, on 10/12/2007, -5/+48hmm, so they decide to do this after google buys.
- blindbug, on 10/12/2007, -9/+50So let me get this straight, utube is suing youtube because utube's site is getting too much traffic? They went from 1,500 visitors a month to 2 million? Instead of paying for new hosts... why not sell utube.com to youtube, and then get yourself a new name...
- zonk3r, on 10/12/2007, -2/+41I think you meant to say 'lose their pants'. Loosening their pants would have an altogether different connotation...
- webcrumb, on 10/12/2007, -6/+38"So he's suing YouTube because people are stupid?"
*sniff* God Bless America *wipes tear* - webcrumb, on 10/12/2007, -13/+44"pathetic"
This has actually been going on for /months/. It's nothing to do with the trademark, it's the fact that they are having to pay huge sums of money for bandwidth that's being generated by a typo, and they get no benefit from the traffic - it's almost a YouTube-sponsored DDoS (you might even argue that YouTube is purposely forcing uTube off the web so that they can take the domain). If you're selling industrial tubing you can't really justify hundreds of thousands of dollars of bandwidth.
I think an equitable solution would be for Google to host the site. Problem solved. - deuceswilde, on 10/12/2007, -5/+33I doubt anyone intending to visit youtube is interested in buying industrial tubes so it's really not that useful other than making their bandwidth bills more expensive.
- jonathono2000, on 10/12/2007, -5/+32@DoctaStooge
Actually the Wrestling guys sued the Wildlife guys over use of the domain wwf.com first, the wildlife guys counter sued and won.
"Professional" wrestling = theater for philistines. - armbar, on 10/12/2007, -2/+25He meant they'll loose their pants, bend over, and take it in the behind from Google.
P.S. and like it too - bpapa, on 10/12/2007, -5/+25So basically, YouTube is liable for everybody's typos?
- MalaysianMafia, on 10/12/2007, -5/+23The internet is a series of tubes...
CONSPIRACY?
*puts on tinfoil hat* - gharding, on 10/12/2007, -11/+25Wahhhhhh I'm getting more traffic than usual :( :( :(
If that happened to me, I'd be psyched! - stevesearer, on 10/12/2007, -2/+16It won't be long before techcrunch reports that Google is expanding their operations to include free, online, ad-supported rollform equipment.
- akinder, on 10/12/2007, -2/+14You know that by posting that a digger is going to register it and do something mean right? :P
- Miyazaki, on 10/12/2007, -4/+16Here's the solution.
New URL: www.utubecorp.com - lazyrussian, on 10/12/2007, -6/+17Hence Utube will loose their pants in this lawsuit unless they drop the case.
- stalefries, on 10/12/2007, -3/+14Reminds me of Mike Rowe Soft, and Microsoft.
- meltingrobot, on 10/12/2007, -5/+16It seems like they would just sell the domain name for tons of money to somebody wanting to cash in on the name and buy another one.
- MacsBaine, on 10/12/2007, -3/+13They need to do what Firefox does. When you go to firefox.com you get a link to Firefox the browser and Firefox the tech company in the UK. YouTube (because they can handle so much traffic) should host a page that does the same thing.
- francisew, on 10/12/2007, -5/+15I'm just surprised that these guys aren't taking advantage of the traffic. I'm sure that if they were to include a 'did you mean to go to youtube?' link, they could probably have had their hosting paid for by google/youtube. This way they're probably going to get nothing.
I think it's quite amusing, because their site is designed to be a bandwidth hog in the first place. It's quite nicely designed, but definitely not bandwidth-efficient. If they had optimized their content, there would likely be no bandwidth issue in the first place. (I'm referring to the self-changing photos under the title, and the .asp pages which seem to be dynamically regenerating static content using ugly page requests.)
*update: I guess utube.com has just found out about the slashdot and digg effects. heh. No more complaining about youtube?* - Brakamow, on 10/12/2007, -4/+13Edit timeout...
I agree that they should sell their domain to Gootube since it _is_ a very large bandwidth problem. They'd probably wind up with a small fortune, too. All because most people can't seem to differentiate between 'you' and 'u' anymore. R.I.P. simple spelling. - FuzzyCat, on 10/12/2007, -2/+11
Just setup a site with "Easy" or "EZ" in it and wait and see how long it takes those ***** at easyjet to come and find you... - bdurkin, on 10/12/2007, -1/+10maybe all the people at the top of this page should sue all the people at the bottom of this page who keep making the same comments.
- undersky, on 10/12/2007, -2/+11I just called them and suggested them to capitalize on their traffic instead of suing. The secretary (Carrie?) thanked me and told me that they had received thousands of phone calls suggesting exactly the same thing. They have explored all options with their attorney(s).
So for those of you who worry for UTube, you can rest assure that they know what they are doing.

(419) 874-2364 - Frozenpython, on 10/12/2007, -1/+9No doubt. If they were smart they would think about changing their name and keeping theutube.com site and loading it with ads if there were getting so much traffic. I bet they would make more money over time doing that then a stupid lawsuit that half of is going to go to some greedy ass lawyers who is probably pushing them to sue...
- Otto, on 10/12/2007, -1/+8If they're really not in it for the money, then this will probably just end up getting settled, with Google/YouTube covering utube's bandwidth bill. Hell, Google might just host their site for 'em. Simple easy way to solve the issue.
- jmg4j, on 10/12/2007, -1/+8Wait, there in business to make money!? That's just crazy. Stop them now before they corrupt the whole system.
- Terc, on 10/12/2007, -6/+12Ademuth,
People like you (or should I say "u") are the very reason utube.com is having this problem.
I'll start quoting "u" now
"they should use this to THERE advantage"
"Where as a LAWSUITE would be a short term..."
Instant message much?
Try and figure out the correct spelling for the caps lock words.
Come back when you can write intelligently - david76, on 10/12/2007, -5/+10@webcrumb
So he's suing YouTube because people are stupid? - Mekun, on 10/12/2007, -2/+6Turn the site into an ad farm. Big money.
- capellathestar, on 10/12/2007, -1/+6Just stop in their office, tell them you were looking for the YouTube office. Be apologetic when they get angry.
- Ubermensch423, on 10/12/2007, -1/+6since when did ohio become a southern state? isnt that accent usually associated with southern, rural folk? last time i checked ohio is in the midwest, if ur gonna be ignorant and use stereotypes dont further display ur ignorance by misapplying them
- inactive, on 10/12/2007, -1/+5Google should issue a press release like this:
Dear Universal Tubing,
We have been informed that your domain, utube.com, has been frequently confused for the extraordinarily popular youtube.com and this is hurting your business. While we sincerely apologize for the unusually large number of retards that can't spell hitting your domain by accident looking for youtube.com, we accept no liability for the literacy rate in the United States or even globally. Despite our greatest efforts to index the internet, nothing can be done if people cannot operate a simple keyboard and mouse to access websites on the internet. We had proposed a knife-to-neck system that administers a stab to end users upon making grave mistakes online, but a Massachusetts court shot us down in the preliminary stages.
We have, however, spent around 30 seconds to come up with a solution for your dilemma. Starting today, if you transfer control of your domain name over to us, we will have our IT staff craft a blank web page with 2 links on it, one leading to your website, the other leading to youtube.com. We believe this will eliminate confusion and allow your customers to successfully locate you on the internet. Furthermore we offer to send you a free Google koozie to keep your canned beverages cold. You will incur no cost other than registering a new domain name, which with services such as godaddy.com, will cost you little more than $10. We sincerely hope this does not crush your company.
Thanks from your pals at Google. - ThirdPrize, on 10/12/2007, -0/+4What with the decline in literacy, its only going to get worse.
- skeeto, on 10/12/2007, -6/+10ROFL. Do they have a legit case? U and You are completely different, despite sounding the same. Come on now.

Looks like three weeks too late... - usbserial, on 10/12/2007, -3/+7Next thing you know YouTub (you know, the company which manufactures and ships bath tubs world wide) will also sue Google also.
- inactive, on 10/12/2007, -1/+5They need to have online lotteries on their site. The only way to clear their tubes is to shoot lotto balls through them and clear out all the youtube videos and poker chips clogging them.
- moonty, on 10/12/2007, -3/+6I wouldn't imagine this case getting too far -- the two are very obviously in different industries, the only real harms UTube might be able to claim are bandwidth costs, unless YouTube decides to enter machining, in which case a genuine problem would present itself.

You're missing a significant bit there:
"FIRST USE: 19961231. FIRST USE IN COMMERCE: 19961231"
Their first use of their mark is December 31, 1996. That is going to be the priority date for their claim. Not the filing date. As soon as they use the trademark in commerce, they get common law rights to the mark. Common law rights are coequal with the scope of the use, and therefore, aren't as geographically expansive as those of a federal registration.
The recent filing with the USPTO is almost certainly a proactive step so this doesn't happen to them in the future or puts them in a better position if it does.
They are being seriously inconvenienced in a number of ways, not the least of which are the bandwidth costs, which are likely significant.
Further, there's the issue of "reverse confusion", which is explained here:
http://grove.ufl.edu/~techlaw/vol8/issue2/feldman.html
Basically, it happens when a massive "junior user" of a trademark crushes a senior user and the senior user loses control over the brand and is damaged in a number of ways (listed in the article). - perkonis, on 10/12/2007, -5/+8YouTube should give them $20 to register a new domain and be done with it.
- gfnw, on 10/12/2007, -1/+3Why should Google have to pay either?
Google hasn't linked to Utube.com, or otherwise diverted traffic there. The extra traffic is a result of user error. - Fett101, on 10/12/2007, -0/+2What doesn't make sense is that his reason for rooting for utube is because he believes Google would sue them if they posted videos.
