Basically what the city's government wants him to do is remove the city's name from his website because it comes up as one of the top ten results for that city. The city then says that because it is one of the main results, people will think that his website is affiliated with the city and vice versa, and according to the city's codes, it's illegal to do this. They're pretty much just notifying him like a police officer would notify a speeder. They even leave the salutation, " With friendly greetings." Ahhh, but think whatever you want.

Yep. I'm sure if they'd handled this politely this would've been avoided.
Something along the lines of "Sir, your page http://www.shopblogger.de/blog/archives/2715-Der-Brief-vom-Sozialgericht.html comes up higher than the official website of our city when one Googles for the city's name. If you could edit that page to add a link to our website and a notice that your site is not the official website of the city, we'd appreciate it a great deal. Thanks for your time".

That argument is not entirely without merit, if a little out of proportion. It's obvious that a C&D is not going to fix it.

I agree that it's a harsh reaction, but it's not outlandish. I'm pretty sure my dad wouldn't get it, if he were looking for the Sozialgericht ("social court") and ended up on a page that looked like this one with "Sozialgericht Bremen" in the header and a large image of a shopping cart (which could be seen as an icon for "homeless").
If their request is simply that he remove their name from his page's header, then I'd say that request is valid and their tone was adequate (friendly, but professional), given that their site's target demographic probably includes very inexperienced surfers and their moms. Of course, they shot themselves in the foot by not understanding the implications of sending a C&D letter to a blogger (gasp!), but then it's not their job to understand the internet. - theone3, on 10/12/2007, -0/+0Heh.
