They have them downloading the same file on dates 07/02/2007, 19/02/2007 and 25/02/2007. If they can only afford an internet connection that takes 18days to download a file that is properly under 200MB, then how can they pay $3500.

I'm a anime fan and I've paid for my fair share of things I spend atleast 100 or so dollars a month for anime I support it but like someone else pointed out I don't want to wait for my anime. I'm enjoy an awesome show called "School Days' thats currently running in Japan as I speak and god knows if the US will get it!
So your killing anime even more now its not like anime is the biggest thing in terms of popularity it has it's niche and I believe we do a lot for the anime community and you give us back some good and some bad quality anime. I mean sheesh we pay though the nose for ONE VOLUME of anime that typically is only 100 minutes and sometimes there are 10's of volumes. Ranma 1/2, inuyasha, Bleach all going over 10 volumes easy yet you charge us 20, 30 dollars each.

A civil case is different than a criminal case. In a criminal case, the prosecution must prove beyond a reasonable doubt that you are guilty. In a civil case, there is a different burden of proof. This is how, for instance, OJ Simpson was found not guilty in his criminal trial (by reasonable doubt) and didn't go to jail but lost his civil case and was ordered to pay the families a ton of money.
The fact that your wireless connection was used by someone for copyright infringement can still make you liable for their losses, just like you may be found liable if you leave a weapon out and someone uses it to commit a crime.
But $3500 is probably nearly what you'd pay in court costs anyway, so do you want to bother taking it up with a judge or ... ? - windwaker, on 10/10/2007, -3/+11why are people digging this down? he's right; you can only be punished through a civil suit.
