proofread your titles man, seriously. - inactive, on 02/16/2009, -7/+721"You hereby grant Facebook an irrevocable, perpetual, non-exclusive, transferable, fully paid, worldwide license (with the right to sublicense) to (a) use, copy, publish, stream, store, retain, publicly perform or display, transmit, scan, reformat, modify, edit, frame, translate, excerpt, adapt, create derivative works and distribute (through multiple tiers), any User Content you (i) Post on or in connection with the Facebook Service or the promotion thereof subject only to your privacy settings or (ii) enable a user to Post, including by offering a Share Link on your website and (b) to use your name, likeness and image for any purpose, including commercial or advertising, each of (a) and (b) on or in connection with the Facebook Service or the promotion thereof."
Yet they STILL can't make any money. Hmm. - Supernova36, on 02/16/2009, -4/+510Summary: "You hereby grant Facebook your soul."
- jaredsgirl, on 02/16/2009, -24/+446I cannot believe that! I'm an avid facebooker and this kinda scares the s**t out of me! Anyone else?
- PacificStandard, on 02/16/2009, -21/+332tearms..seriously, professionally, we're ***** over man.
- FreeMySpeechCom, on 02/16/2009, -0/+273"You hereby grant Facebook an irrevocable, perpetual, non-exclusive, transferable, fully paid, worldwide license...to use your name, likeness and image for any purpose, including commercial or advertising, each of (a) and (b) on or in connection with the Facebook Service or the promotion thereof."
Usually, I find these types of articles pure hyperbole, but this sounds pretty serious.
Use of Facebook is a matter of surrendering one's identity, it would seem.
Shouldn't their users have to accept a new license agreement if the terms have changed this dramatically? - LuxFX, on 02/16/2009, -3/+209Facebook: We put the "Tear" in Tearms
- hauntedchippy, on 02/16/2009, -0/+180//Shouldn't their users have to accept a new license agreement if the terms have changed this dramatically?//
Yes this is the part that's bothering me, why haven't I been told that the terms have changed? Shouldn't there be a notification period in which time one can remove content? - MavRevMatt, on 02/16/2009, -4/+184Sadly I think this is what Facebook was made for. Information harvesting.
I'm tempted to cancel my account now and not get any farther in. - TheVirus, on 02/16/2009, -52/+188Don't like it? Don't use their free service.
- MeatyMcBeef, on 02/16/2009, -1/+124Elsewhere in the Tearms of Service it probably states "subject to change at any time without notification."
- DeusNova, on 02/16/2009, -22/+137Glad I never started facebooking.
- chriscalifornia, on 03/31/2009, -32/+144That's almost as disturbing as it is irrelevent.
- mdoom, on 02/16/2009, -2/+114Ever tried cancelling your account? Its a lot harder than you think...
...they won't ever cancel it, they'll keep all information so you can "re-activate" your account after changing your mind.... - SovereignGFC, on 02/16/2009, -1/+100I've been saying it for a long time--DO NOT UPLOAD ANY ART OR OTHER CONTENT TO WHICH YOU WISH TO RETAIN THE RIGHTS TO FACEBOOK!
- rawnnie, on 02/16/2009, -8/+99Of course not. You're on Digg. You have no friends in the first place.
- Sublex, on 02/16/2009, -3/+93Nothing wrong with bitching about it and spreading the word.
Wanting to pass a law though... - Holosoth, on 02/16/2009, -1/+91As soon as I post this on facebook, they own it. Maybe they can use it as their new logo.
http://img13.imageshack.us/img13/4303/youhavenorig ... - CarGuy, on 02/16/2009, -10/+85You don't have to give them your correct information.
- ZeroCubed, on 02/16/2009, -0/+71Thanks for telling me! I'm an animation student and copyright issues are a big deal for us. While some of my old videos are up on the site, I haven't put any of my new animations and videos yet. This is low and dirty of them.
- Ikulus, on 02/16/2009, -4/+72It says "subject only to your privacy settings". If you've got your photos set to "Friends only" then FB can't do much with them.
- inactive, on 02/16/2009, -1/+66Only professionally? ... Are you asking me out?
- WebmasterNeal, on 02/16/2009, -0/+65I've noticed that Facebook doesn't delete your pictures from their server if you delete it from their site. I did a test on this before be copy the direct URL to a picture before I deleted it and then I monitored the URL for awhile. After two weeks the picture remains on their server.
- GrooTheWanderer, on 02/16/2009, -2/+66I hereby grant Facebook the right to sod off and die.
- Nauru, on 02/16/2009, -4/+64We're f***ing done professionally man, seriously.
- stijnbraas, on 02/16/2009, -1/+59It's funny that terms of service always make you feel like that once agreed, they own your life eternally. Thankfully at least here in the Netherlands we have laws that, even agreed to TOS, protect you from this kind of bull. Laws are always more important then TOS, even if they make you seem like they aren't.
Then again, I'm pretty sure that a major part of this TOS is just to protect Facebook from lawuits by leaving 'deleted' content on their server for at least a while. - inactive, on 02/16/2009, -2/+55Spot the guy who's been pretending to be a 15 yr old girl on facebook...
- ChristBehemoth, on 02/16/2009, -1/+54No you didn't
- toxicpiano, on 02/16/2009, -1/+53So what will happen to all this info when they go bankrupt?
- babydick, on 02/16/2009, -2/+53In Soviet Russia, Facebook owns You!
- mythz, on 02/16/2009, -3/+54maybe they meant to say TEARms
- Kyrgizion, on 02/16/2009, -1/+51Then it gets sold to whoever buys the bankrupt company's assets.
Real reassuring thought, innit? Especially if that turns out to be, say, a private health organisation, or worse yet, an insurance company. - wild, on 02/16/2009, -0/+49Fun with commas:
"we're *****, done professionally" - coondog35, on 02/16/2009, -1/+49Parents joining facebook will ruin it before this will.
- fyrfyter, on 02/16/2009, -9/+56Know what scares the ***** outta me? The fact that people here cannot spell basic words, like Terms.
- chrisrad, on 02/16/2009, -4/+49them? at you?
- Acet, on 02/16/2009, -0/+43I tried to find the place where i could say "i do not agree with these new terms of service and wish to erase all data ive uploaded" but i couldnt find any way to do that..... does anyone else know if there even is one?
- darlingt, on 02/16/2009, -0/+42It saddens me that someone who is trying to correct the spelling of someone who is trying to correct someone's spelling can't spell "derivative."
- anyone4apint, on 02/16/2009, -1/+41This means that Facebook will have global rights on all of the flash picture things that I send to my mates which bring into question their sexual preferences towards other men and various farm animals, oh noes!
- jzamoras, on 02/16/2009, -2/+41Is there a way to download your contacts and get the ***** out of facebook?
- StuartGibson, on 06/14/2009, -1/+40Yet we still know you're in Chandler, Phoenix Arizona, have a jailbroken iPhone, use Gmail, play WoW, like football, listen to the Pork Dukes, had a female Phantasy Star character called Kassiopeia, own a GatewayLX6810 and voted Democrat, though without the burning pride that many had.
It's not like we're going to identify you just from that, but I'm sure we could get more if we tried.
Oh, wait, your real name is Ryan Vidales and you're 24.
How did I do? - ZippyV, on 02/16/2009, -6/+44They just don't want to be sued because they're keeping your pictures on their servers. Pretty much every website has such a policy.
- taketheleap, on 02/16/2009, -0/+38As noted above, there is probably a clause in there that states "subject to change without notice."
I'm not sure how this would stand up in court - since you would have accepted the terms before they were changed - but I'm sure you waived your right to care somewhere in there too... - unknamed, on 02/16/2009, -0/+37Or to the internet in general....
- illestlyrics, on 02/16/2009, -1/+37They still own you.
- linagee, on 02/16/2009, -17/+53What tearms of service?
- mattharvey716, on 02/16/2009, -0/+35what happens if your account was made before this TOS change?
- iconnor, on 02/16/2009, -1/+34A key word in all this mess is "non-exclusive" - so you can still do what you like with it. They mention, it is subject to privacy settings, which seems to indicate they won't use photos you keep private - but I wouldn't trust them.
Also, their ability to sublicense means if you do have a really good photo, share it and it gets popular - they can compete with you in terms of reselling it and can undercut any price you set. - airwalkery2k, on 02/16/2009, -0/+32But, what if they try and sell my list of 25 things about me?!
- Queue29, on 02/16/2009, -1/+33It's too late.
