EAI has denied and continues to deny the claims and any wrongdoing, but has decided to settle to avoid the cost and inconvenience of litigation. The Court has not issued any rulings about the validity of the claims. "

I do know why they are being sued. It is because Epson printers tells you that you are out of ink when there is still ink left. Furthermore, it won't let you print anything until you put in a new ink cartridge. This really stinks when you are out of black ink and you want to print out text in blue (or some other color). - Circuit, on 10/12/2007, -2/+8Shame this is only for the US :(
- rhettnyedotorg, on 10/12/2007, -0/+6The epsons (and canons) use a little chip that attempts to measure how much ink is left in the cartridge.
Because epsons have 'ink tank' cartridges, and printer head unit is inside the printer itself, it's important to avoid running the printer when it's dry. HP and Lexmark for the most part use 'print head cartridges' with the electronics and actual print-head right on the cartridge, which is eventually disposed and replaced. Epsons and Canons use just ink tanks, this chip technology seems to be the weakest in the industry. I think Canon has a prism in their cartridges, and when the cartridge is close to empty, light can get in to the empty cartridge and though the prism ink level measuring system.
you can hack the ink level on epson chips with 'chip resetters'
these are required after refilling the cartridge, but also come in handy when you need to get a couple more pages out and your printer refuses to cooperate based on being 'out of ink.' dangerous though because running the printer when it's empty can be really bad for it (the print head in the printer is the weakest link)
another attribute to ink tank cartirdges is that they have a large opening which tends to dry out when exposed (ie. when the cartirdge is removed)

It's still got 3/4 black ink left, which is useful for printing documents. Well, the printer now refuses to function without ink in the color carts even if I tell it to just print in black!
Epson can shove it. That printer is now sitting in the corner collecting dust while I use an old HP printer that isn't trying to rape me. - davidjunit, on 10/12/2007, -1/+6What gets me is, how Epson could deny the claims! Then I let it sit a few weeks (with ink in it) and the ink pump dryed up, (WITH INK IN IT)I tryed running water threw it like it says online to do, and this is a very common problem with these printers.
So come on my Canadian geek brothers lets post our serial numbers so epson pays threw the nose!!

I got a letter in the mail and posted it online at slickdeals.net. It is a class action lawsuit. I have my $45 dollar code already because my printer was already registered.
- thesbian12, on 10/12/2007, -1/+4methinks thou art unskilled in the ways of literacy. In order to "collect" you must have bought a qualifying Epson printer. According to what I understand about legal theory, buying one of the qualifying printers means you fell for or were defrauded in a way you didn't immediately understand by an Epson scheme to skim money on printer cartridges. Thusly, you are entitled to some bling if you bought some of their crappy stuff.

I don't see how this hurt Epson. Very few people that bought these will actually fill out this form. So they just got some cheap advertising for their ink store.

However, this looks an awful lot like the Nintendo lawsuit from years ago. I didn't even know about the E-Store and looking at the prices there, you ultimately end up spending money if you expect to use up the entire E-store coupon. Exactly what Nintendo did by offering $5 coupons towards any SNES game. They knew that even knocking $X off, the customer is still going to have to spend money. Since I'm going to be spending money regardless of what I do, I think I'll opt for the $25 check and $20 coupon to offset the cost of the ink cartridges I need, which ironically, is $14 cheaper for the ink multi-pack, *after* I calculate in the cost of shipping. - hypercube33, on 10/12/2007, -0/+2I had an epson 640. When you'd use it once a week or so, it'd start to streak all over your paper, and you'd have to clean the heads. Doing this dumps ink all over the inside of the printer (literally, all over) and then you'd get ink spots on anything you'd print.

- TWiThead, on 10/12/2007, -0/+2Just last week, I received a telephone call from my grandmother. She needed to print some important documents, but her Epson printer (one of the ones from the list) had run out of ink. In retrospect, I suppose that this might not have been true.
I replaced her cartridges with spongeless, auto-reset units from a third party. The kit (complete with enough ink to fill the cartridges six times) cost only slightly more than the outrageously high amount that one would pay for a single set of official Epson replacements. I have had nothing but problems (ink related) with my Epson CX4600. It will definitely be my last Epson printer. - luma, on 10/12/2007, -0/+1This is great! I have an Epson R800, and while it is a fantastic printer (especially the direct print on CD/DVDs), it chews through ink like crazy, and for $15 a pop * 8 ink cartridges, it can get expensive quickly.
The class action concerns the fact that their printer drivers will detect the amount of ink left, and refuse to print if any of the ink carts are empty. Of course, it does this before the ink cart actually runs out. Some crafty russians have figured out a way to reset the cart chips via software.
